CPS Midlands - Back with Letter of Claim for a PCN issued in Sep 2015

    Without the original PCN showing the date of the event and the PCN number that matches the one on that letter, there is no proof that the claim is statute barred.

    I suspect the omission of the date was deliberate for that reason.

    But it isn't a real LBC anyway just a standard letter from TNC/CIS so you just ignore it.

    There's no 'verdict'. You will get views from regulars. More often than not they are absolutely contiguous, sometimes you'll get views that are slightly different, but lined up on the same target. Whichever view you take here won't matter much. 

    You can follow @Grizebeck's suggestion to do nothing more, with nothing more serious following as a result. Alternatively you can write back to whoever and ask for the date of the parking charge. If you get a reply to match the date you presume it to be (and statute barred) you could kick up a fuss with the IPC, DVLA, your MP (and Uncle Tom Cobbley and all) to give the PPC maximum inconvenience and possibly a bit of pain. 

    But you will need to be determined and focused on doing that ..... please don't come asking for templates, you'll have to compose your own letters of complaint and be prepared to see through your intentions. 

    Here's another thought, if you are writing to seek out the date, tell them they need to help you narrow this down as you have (think of a number!) x outstanding parking charges and you're not sure which one they are pursuing given their lack of detail. That will get their juices flowing, chasing shadows, seeing if they can extract some more pounds, waste their time with half-truths as they seem to be doing with you. 

    All views are of equal status, depends on the game you want to play and what efforts you are prepared to put in!

    For what it is worth, I believe in giving these cowboys as much trouble as possible. So I would be following the excellent suggestion of Umkomaas above. Anything that wastes their time and money is good.

    I would start with an SAR to the DPO of CPS Midlands as per the NEWBIES guide. This will flush out a copy of the original PCN/NTK (and any others for that matter), at which point you will then know for certain if the LoC is or is not statute barred by comparing the PCN number on the PCN and the LoC.
    You will need to include non-photo proof of ID with your request.

    It is possible that this is for a more recent PCN than one from 2015, so you need to establish that at the very least.

    Depending on what you find out, you may to decide to ignore the LoC if more than six years have passed, or write to tell the PPC it is statute barred. You may also want to make complaints about the PPC and their agents if it is statute barred.

    Personally, I would kick up a stink. 

    Please tell us the results of your SAR as C-m will need to know for certain if the PCN is indeed statute barred so she can show the powers that be that lies about debt collections and the PAP are being proffered by PPCs.

    Please firstly do what I suggested. 

    Get another phone to record the call and ring the number on the letter, putting it on loudspeaker.  Start vague and ask what this is all about.

    Be polite all through the call even if it means biting your tongue, going silent and letting them fill the silence.

    Press them for some details because you have no idea what it is about. Ask for a PCN ref and the location and date of parking.

    If it is the 2015 one, ask the person at the other end how they intend to progress this, because "isn't it statute barred?"

    Ask them if they are CSA registered and why they are chasing a seven year old PCN.

    Record everything but stay calm. 

    DO NOT BE MISLED.  THEY WILL TRY TO MAKE YOU FEEL LIKE A DEBTOR WHO MUST PAY.

    IF IT ISN'T THE 2015 ONE, JUST ASK THEM TO POST YOU A COPY OF THE PCN IT IS ABOUT, AND END THE CALL.

    Do not falter if they start shouting or lying, just record the call. I really want some evidence of DRAs lying to people and being aggressive on the phone, so I can use if against the industry in my submissions to Government.

    Wonder how many motorists have been sent this letter ?  We can call it the "statute barred." scam

    The scam is spotted when they say to pay CREDIT INVESTIGATION SERVICES ??
