Does DCB Legal actually pursue beyond Letter of Claim?

I'm at the point where we've received the "Letter of Claim" from DCB Legal and I'm just curious as to what the odds are they will actually proceed. In theory I know they should be client led, but suspect they may not be.

    It's not up to DCB Legal Ltd. They will do as instructed by their client.

    The PPC will continue.

    100% yes. It will be followed by a court claim because this is a robo claim firm.

    Except if your response is so robust and difficult that they put the case in a drawer and choose a lesser victim. What you do NOT do is ignore it.

    Which parking firm is bothering you?

    Have you not yet read any other DCBLegal threads? We have hundreds. Very easy to beat in court and they usually discontinue when they see a forum WS and evidence bundle.

  • Yes, I've read through a number of the DCBL threads, amongst others, but I was trying to get a feel for whether I should actually bother wasting time compiling the formal defence at this stage or not.

    The parking company is a small, local one, and the search here has failed to identify any previous threads. It is run by the director of a chain of shops, that the parking is for.

    I have spoken to and emailed the director directly and he is fully aware that I won't fold and pay, there is a matter of principle at stake, and while principle alone won't win it, I've already identified a number of technical issues to tackle their claim with.

    I'm deliberately being vague as I'm sure DCBL must read this forum and I don't want to show my hand at this stage.

    I have submitted a fairly blunt response to DCBL, they know exactly where I stand and that I'm up for a Court appearance, just trying to assess whether they pursue regardless, or not, as I do have other stuff to do!

    I'd be surprised we've never heard of them if they're active. Are they a BPA or IPC AOS member?  Just tell us the name, there's no danger even if DCB Legal read this thread, they are a conveyor belt operation, not interested in any detail. What are you worried about if they read this?  It's a parking charge, not some MI5 operation. 🙂

    I have found DCBLegal shrink away when sent a really robust response identifying the issues with their client's case and asking for documents as required under the PAP. And telling them that their client must 'put up or shut up'.

    That's worked twice for me in recent years when I wrote a 'snotogram' to DCBLegal for friends.

    Try what I already suggested. Make your case too difficult to progress and a claim might not follow.

    They were actually incorporate four years ago, so not newcomers, just not a name we are used to seeing.

    They do but do they actually know why because Robo claimers use the court system like a public conveinience hoping you will give up and pay.

    In reality, as we keep seeing, once the real facts are placed in front of them, THAT'S YOUR WS....  the dreamworld of the PPC becomes less attractive which means we are seeing court spankings and a phase where they discontinue

    This takes us back to another legal, BWLegal, on their journey to collect monopoly money. We watched numerous court spankings 
    DCBL tried to take over but have failed. We are watching a repear and it is getting boring.

    Using a Robo claimer could well cost Carparkers (Anglia) Ltd a lot of money

    We have seen recently a spate of little known parking companies taking the route of a Robo claimer.  They all seem to be BPA members, sounds as if this could be bad advice from the BPA who cannot be trusted?

  • I'm actually after one of two scenarios, either Court or a formal withdrawal of claim. Limitations Act allows stuff like this linger for 6 years, just going quiet on me isn't going to be acceptable, he's !!!!!! me off, I want it closed. Guess I'll have to wait for the next move.
