I'd like to get people views on a fine me and my colleague received from Euro Car Parks.

They basically run the car park where we work and we have both received several fines for parking there last month (separate days oddly enough). This was because they didn't have our car details on record to park there. However when we moved in I sent over email our car registration number, make and model. I've double checked and this is to the correct email address and according it was delivered. In fact when I questioned the fine at reception they asked me to forward the original email, I did that on the spot and it was received instantly. So I doubt it went to span or anything. It clearly looks like human error on the buildings part.

We are now in the system and have requested the building manager to sort this out. They seem a little apprehensive and can't seem to promise us anything. I've also requested a copy of the tenancy agreement from MD to find out what we agreed on in regards to this. In any case they should have sorted and once I have all the info I'll appeal.

Has anyone been in a similar position or has any general advice on this. It'd be much appreciated.

this is not a fine, what rights do you have to use the car park?
the parking company is no more than a contractor working for the managemetn company/building manager

It's an office building car park, we have the right in the sense that we were promised the spaces with our tenancy agreement and that they asked us to send over the car details to avoid such a situation.

I hope you're right about the parking company being a contract and that the building manager can sort it out. Like I say I'll appeal, if that fails I'm not sure if I'll pay and let it play out.

No need to hope. That's always the case.

You've read the NEWBIES FAQS thread first we assume?

...and know the complaint is PLAN A and comes BEFORE any sham 'appeal' and that the first 14 days means nothing and is not your appeal deadline. Please read the Announcement first and don't rush any appeal.

This is not to be paid, even if the sham appeal is lost. We assume you are in England?

All stages are fully covered in the NEWBIES thread but get the owners to stop faffing and TELL their agent to cancel these erroneous PCNs.

    Thanks,

    Yes I am in England.

I've had a look at the newbies page, I did complain at the building reception and have sent an email to the building manager explaining the situation, I asked him to resolve this. I haven't gone in angry but maybe will have to depending on his response.

I'm waiting on the tenancy agreement, that can maybe offer some help.

A further development on this, today I received 4 more letters from Eurocarparks and probably many more are expected.

Spoke to the building manager said they'll speak to Euro car parks but can't "tell them" to cancel it. He said he can only lean heavily on them.

I'm thinking of seeking legal advice. This could be up to £1000s pounds.

Do you think legal advice will be better than forum advice?
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

I was thinking more against the company managing the office because we did everything they asked in terms of sending the car details. The manager claims the emails wasn't received and it's an IT error, some firewall. No he can't promise that the charged will be cancelled.

I'm waiting on the tenancy agreement to see what that says about the parking spots we were promised. I'm not sure how much it'll help but maybe it can show they didn't fulfill their obligation in regards to this.

As for Euro car park on Monday the management can't get it cancelled then I'll wait 26 day (I think) to appeal and go down that route. Thing Is I have 4 charges and my colleague has 3, like I said more are expected, do I need to appeal each one individually?

I'm not an IT expert, but I would have thought you'd have had a Daemon-Mailer bounce with a 'failed to deliver' message.

    Yes - but not yet.

Lean more on the building manager and yes, if necessary sue them. Certainly tell him that will be your next step if they fail to call their dogs off.

@zhonguonuren has threatened to sue a landowner before, I think.  She might pop by with advice.

More people should do that, to end PPC scams. It would make landowners think twice about their rogue agents.

  • Hi OP.  I just happened to be online.

The tenancy agreement would definitely help.

If you can prove you sent the email it will be sufficient.  If the company say it did not receive it that is not your problem.

Do you know who the landowner is?  If not, I can help you with that if you DM me.  I am not on here very often as still trying to save Hayle Harbour!
