DCBL - advice

Hello, 

DCBL are chasing me for a parking ticket from early July 2016. 

Am I right thinking that once it has been 6 years they can’t do anything? (Satute barred I think)

Also that they can’t add money to the ticket? 

When they contacted me I asked for evidence as advised online which took them 6 months to reply and send back a blurry photo where the licence plate is unrecognisable. 

They have asked me to pay by Thursday.
 
Assuming I am correct about the 6 years would you recommend I respond via email requesting clearer images and their legal entitlement to add charges to the ticket to delay them a couple weeks to hit the 6 years.

    Yes, definitely. 6 years is correct for England/Wales.

    And add that you are seeking debt advice and as such, under the PAP for debt claims the case must be put on hold for 30 days.

    You need to filibuster this to prevent them issuing a court claim. If they do that before the 6 year anniversary, you can forget any statute barred escape route - the claim will be in time and you will need to defend it. 

    To do this, you should follow @Coupon-mad's advice, sending DCB Legal a response to their letter, telling them they must put the case on hold for at least 30 days as per the Pre Action Protocol for Debt Claims as you are seeking debt advice (use those words) - the NEWBIES FAQ Announcement, second post, gives you more information. 

    If 30 days takes you over the line, that should be the end of any court proceedings. In theory, DCBL can still, though highly unlikely, continue to chase you for the parking charge - for ever - but can't issue a court claim. 
    Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

  • Thank you all for your help. 

    I had already asked for the 30 days. But the last two weeks I have emailed and asked for clear images as the ones they sent are blurry but they deemed this irrelevant and kept giving 7 days. This final 7 days which I have received will get me past the 6 year date.

    You will also, no doubt, be keen to respond to the final public consultation this Summer to stop the parking firms from blocking the new Code of Practice.
