Oh okay. So that’s it? It’ll get set aside?? They’ve sent it to the court already and they CC’d me in.
Not automatically.  The Judge might not like the Order and might not agree the grounds are made out.

You can only wait and see.

Okay, so do I still need to attend the hearing then? Or will I be emailed the decision?

You'll have to ring the local court a day or so before, to ask if the hearing is still going ahead if you don't know by then. Assume it's going ahead. Read what happened in @paulr23 's hearing this week.

    Hi, just received this from the court;

    Dear Sir/Madam
I refer to the above matter.
The hearing listed for 9 August 2022 has been vacated following consideration of the consent order filed.
An order will be sent to the parties in due course.

    Can anyone translate? 🤣

Did you file a consent order signed by the PPC as a way of getting your CCJ set aside?  If so, it looks like that has happened and you will get an order telling you (and the claimant) what to do next.  Probably that the claimant must file new particulars of claim or refile the whole claim or the judge has struck it out.

Hi, yes a consent order was drafted by BW legal on behalf on the claimant and I signed and returned it to them. BW then submitted it to the court last week and cc’d me in. Then I received the email above.

It means a Judge is looking at the case.

  • Hi everyone - sorry for the slow response in updating you all. But my CCJ got set aside! Didn’t get any money back as we agreed no order to costs but it’s not on my record anymore! Very stressful few months but worth it in the end. Couldn’t have done it without any of you on here (especially @Coupon-mad!). Thank you all so so much.

Very good news and it is all over as this was a Consent Order.

    But...

...please don't leave us yet!  Stick around.

We need you - as a genuine PPC victim of aggression, sharp practice and what the previous DLUHC Minister called out as 'extortion' - to respond robustly to the Public Consultation on the level of parking charges and banning of the false added DRA 'fee' that too many honest motorists currently fall victim to.

It will need consumer input (powerful voices) but change is afoot. It's taken about 5 years to get to this stage:
    https://forums.moneysavingexpert.com/discussion/6333036/breaking-news-government-has-announced-the-statutory-code-of-practice-and-enforcement-framework/p1

And then the industry threw victims' money at it and blocked and delayed it - explained here:
    https://forums.moneysavingexpert.com/discussion/comment/79310609/#Comment_79310609

Please now Bookmark BOTH threads and set up email alerts on your posting profile, so that you get an email alert when we post there, as we will, once the Public Consultation opens later this year, once the new Ministers are fully appraised.

We need people like you and your driving family & friends to respond in high numbers! You have a personal story to tell about the culture of getting a DRA to add a pointless £70 for their own profit, to be let loose to intimidate people.
