fantatsic news, well done! What reason did the judge give for dismissing thier case?2

Went to Skipton County Court for the hearing and VCS hadn't filed any evidence but as I was late... nearly balls-ed it up for myself there.. their rep got VCS to email an evidence pack to the Court. Judge was reading this when I arrived half an hour late, and of course if I hadn't turned up at all the Judge would have ruled in VCS's favour.
We then had a hearing and as the Court nor I had had the original evidence pack from VSC I quietly but respectfully asked the question of the Judge and insinuating at the same that VSC had seen an opportunity, with me not being on time, to send the evidence pack by email that day, and that they hadn't sent it to either the Court or myself before. The Judge concurred and asked VSC for evidence within 14 days that they had indeed sent the Court and myself an evidence pack, and gave me 14 days to respond from there and then a date would be set for another hearing. The Judge also asked for additional information from VSC in their response such as the road name, full colour photos of the signs and also on my request proof of when those signs had been erected.
The 14 days had passed 3 days ago and i was just wondering when it would be appropriate to write to the Court to ask for the case to be dismissed and also for my costs, today I have just received a Notice of Discontinuance from VSC. Still going to write to the Courts to ask for my £95 in costs though.
Was a bit daunted following this thread at first but all the info anyone needs is in the Newbies Thread and other posts linked to it, to beat these cheats...Happy Days...6 -
Perhaps of note is that the defense I used was the one in the Newbies thread, with my personal circs entered into the first couple of paragraphs as advised, and the Judge in her comments at the beginning of the hearing said 'I note Mr XXXXX that your defense is very comprehensive'.4

Well done, nice result. Who was the Judge please? Skipton Court is noted as a bit of a PPC graveyard.'I note Mr XXXXX that your defense is very comprehensive.'
Full kudos also to @Coupon-mad for her sterling effort in constructing 90% of the Defence template. 👏
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

Well done on your win
. Always good to see a win against VCS/Excel.
"Presiding was the very nice lady District Judge Skalskyj Reynolds."
I think that she may be of Ukrainian origin.

Quick update. Emailed the Court a couple of weeks ago asking for costs of £91.90. Heard back within 5 days with the Judge finding in my favour ordering VCS pay me the £91.90.Have received a check from their legal representatives Elm Legal for the full amount. As long as it doesn't bounce that’s a slap up meal for me and my good lady next weekend.
Thank you again for everyone who has contributed on the Newbies thread and others that really helps peeps like me fight these crooks.2 -

Don't disappear just yet. We need you!
What a waste of your time this was, and why should there be such a litigation culture in parking? It's truly horrible being pursued for £100 for no reason, by an ex-clamper aggressive firm, isn't it?Join us in trying to end the conniving PPC and DRA court culture this Summer because £100 plus the false £70 'fee' is extortionate.
If you are not likely to pop back here every week to check, please set up email alerts for this forum and bookmark this thread (below) as we intend that one of us posts on it when the Government opens the Consultation:

The PPC moneymakers have blocked the new Code with Judicial Reviews. Stopped the declared and much welcomed parking code from February 2022, which stated that added £70 false 'DRA fee' extortion was to be banned and that parking levels would start at £50, like Council PCNs.
Together, we can stop the rotten parking industry from riding roughshod over the new statutory Code and the charge level caps, and otherwise bullying all motorists forever, using the regulation to gain kudos and status.
This Summer will be your chance to make a difference, plus any other drivers you know (family, friends) who are also fed up to the back teeth with the greedy and unscrupulous parking industry and the stranglehold they have on people.
We need high numbers of real victims to make a point of responding to this final Consultation.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
