Amex chargeback gone to debt collection agency (EOS solutions)

Basically it is down to proving what you paid for against what you got.lisyloo said:
Oh thankyou.Deleted_User said:
You can do a partial chargeback e.g. only one item was damaged or missinglisyloo said:My personal experience of chargebacks is it’s all or nothing.
can you advise how you do that with either Amex or MasterCard.
So in the OP's case they would need to prove what they paid for. Invoice etc. Then prove what they received. Pics invoice etc.
But again knowing how the car hire co's deal with chargebacks. They never contest. Just pass them on to team to chase the funds owed.Life in the slow lane0 -
I had an issue with NewDay - perhaps they are just not very good.Sandtree said:
With both you contact your card issuer... obv AmEx is slightly unusual as they issue 95% of the cards on their network whereas Mastercard dont directly issue any cards.lisyloo said:

They tend to take a fairly binary approach and so will refund what you say was the price for one of the items or all of it etc, what they dont tend to want to get involved in is where you say you paid £300 for an item but it had some problems so please chargeback for £100 to represent what'll cost me to fix it etc.
there is no place online to specify the amount you want refunded.
I specified what I wanted in a letter (it was a ticket “insurance”).
the chargeback was denied because the retailer said the tickets (a different line item) had already been refunded.
perhaps newDay aren’t very good, but there was no place to specify it on the NewDay interface and trying to get one item charged back didn’t work with them.
amex customer service is better usually.0 -
Your understanding is wrong. Would you like me to show you my credit file?WillPS said:
I don't believe this is true. My understanding is that credit agencies can collect data from organisations who the consumer has agreed to a credit relationship with as well as the courts. If the OP opened a credit account with Hertz, this debt and thus the credit arrangement could be transferred to a debt collector, but that isn't what has happened here.amexblue said:
No but the collection agency they refer it to can.Sandtree said:
Its unlikely that Hertz are reporting to the credit reference agenciesamexblue said:Then wouldn't it make more sense to just tell them a figure you'd be happy to settle at? They'll probably still mark your credit file as partially settled.0 -

A debt collector can only report if the original agreement allows for reporting to the CRAs. To do so without your agreement would be a breach of the Data Protection Act.
Either your agreement with whoever you are referring to has this provision, or they're breaking the law.0 -
