Amex chargeback gone to debt collection agency (EOS solutions)

    How? The OP does not have a credit account with Hertz nor the debt collector.

    No but the collection agency they refer it to can.

    I don't believe this is true. My understanding is that credit agencies can collect data from organisations who the consumer has agreed to a credit relationship with as well as the courts. If the OP opened a credit account with Hertz, this debt and thus the credit arrangement could be transferred to a debt collector, but that isn't what has happened here.

    So I spoke with amex and they say it's now nothing to do with them. I spoke with EOS and they intimated that they have not bought the debt from Hertz but are managing a "Hertz account". They wanted me to come up with a figure that I would be happy to settle at, which to me sounded suspiciously like them trying to get me to admit some liability. I just told them to either serve me court papers or stop contacting me.
    Well you do have some liability for the debt.
    you had a car - did you expect it for free?
    I don’t think they agree with that (neither do I FWIW).

    I’m no expert but I think it would be a good idea for you to come up with a figure that you think is acceptable for what you did have because you did have something.

    Upon return to UK I tried to contact Hertz twice via the telephone to discuss a partial refund. I could not get through the Hertz as their automated telephone system just sends you around in circles (still blaming it on covid). 

    So I decided to do a chargeback on my amex.
    Did you literally jump straight to chargeback after twice failing to get through by phone, or did you have any dialogue with them via one or more of their other customer service channels?

    Did you have the option of claiming a partial refund via chargeback or was it all or nothing?

    Both questions are obviously too late for you now but may be of assistance to other readers to avoid a similar situation in future....

    My personal experience of chargebacks is it’s all or nothing.

    can you advise how you do that with either Amex or MasterCard.

    With both you contact your card issuer... obv AmEx is slightly unusual as they issue 95% of the cards on their network whereas Mastercard dont directly issue any cards.

    They tend to take a fairly binary approach and so will refund what you say was the price for one of the items or all of it etc, what they dont tend to want to get involved in is where you say you paid £300 for an item but it had some problems so please chargeback for £100 to represent what'll cost me to fix it etc.
