I don't get the gist of this, every indication I have found on line about this hotel is that parking is limited but free to guests who have to register on site.
As such surely they don't give up this facility to anyone that wants to park and take up their visitor's spaces.
Personally I think you might struggle with this one, unless you can persuade the management their staff mislead you.

Going by the opening post it would appear that the car park is available to non guests as long as its paid for - thats the impression that i get.
It also appears that the OP also moved the vehicle off site as soon as it was clear they payment system wasn't working ( why do so many PPCs seem to have issues with online/app payments??)  So a complaint may still be valid and worth carrying out.
It also appears the OP dealt with a  member of staff at the hotel, so if they hotel fails to co-operate with a cancellation then you could ask the hotel that their staff member(s) may be required to attend court under oath as a witness.

And as for the opening post - if the original poster is reading this - while its too late in this situation, ithas all the hall marks of shooting oneself in the foot - never attempt to give away the ID of the driver never use identifying terms  terms like I did this or that

Yes that's the impression I got but not the impression you get if you search on line indeed the hotel website just says free parking maybe the OP can give the link to the booking site they were given?
  • Hi everyone, thanks for the advice on this.

I went to the hotel last week and the host there said this happens all the time and that if I drop them an email they will be able to cancel the ticket.

The email i've sent to the hotel

    "Dear Campanile

Sorry about the delay between me coming into the hotel and me witing this i email i thought it had sent but was in my drafts.

I received a parking ticket from Parkingeye for parking in a bay for 50 minutes without a ticket. I intended to stay in the car park whilst I was staying over at a friend’s flat at Wilburn basin where there is no parking available. My friend advised me to use the campanile hotel car park as it was relatively close to his flat. I arrived, parked up and entered the hotel to ask about the parking arrangement. The host there was really helpful and gave me a website to visit to book a car parking space and pay for parking. There was a queue in the hotel so this added to the amount of time I was there. I figured as it was dark and cold, I’d resolve this at his flat. It’s a 10-minute walk to get into his flat and when I got there started to fill out the form only, I couldn’t book a space as there were no free spaces according to the website. I tried a few more times hoping it was a mistake, but it wasn’t, and I had to go back to the car and move it to another carpark. The total time I was in the carpark came to 50 minutes according to Parkingeye and this is the basis of their fine.

I came into the hotel on 11/06/22 and asked the host whether they could help me out with the situation. The host said to send over the ticket details and they would be able to contact ParkingEye to help me resolve this.

The parking reference is ******* and it occurred on the 14/12/2021.

If I can provide any more information please contract me on or on this email.

    Many thanks"

I took this photo of the T&Cs set out by Parkingeye and it doesn't mention the detail that you can pay for a parking space on the site provided by the hotel which is on their business card. It's campanilemanchesterparking.com for anyone interested.

About to starting writing the defence but I think the main point is that the T&Cs don't mention that the parking isn't actually just for hotel guests. Any advice on the defence letter is much appreciated

    Thanks

Have you read the Template Defence Announcement which will give you almost all of your defence ready-written? You just need to describe briefly the background to your parking event. It's 90% done for you.
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

No, it says Hotel guests must.

It is silent about what other (non Hotel Guest) drivers can do to be authorised.

I think the OP is saying that the hotel also offers pay and display as an alternative contract for drivers at large.  Nothing on the sign about that; nothing relevant to non-Hotel guests.
