TV replacement

I have had to have my TV repaired under warranty (the warranty ran out while tv was being repaired) When the tv was returned it was still faulty and had some minor damage. Am I entitled to ask for a refund or replacement rather than another repair

Who did you initially approach? Was it the retailer or was it the manufacturer? (You don't say but I presume it's a manufacturer warranty?)
If you chose to have it fixed under warranty, then it depends on the terms of the warranty - which nobody here can read.
If you chose to have it fixed under warranty, rather than enforcing your statutory consumer rights against the retailer, the retailer might be entitled to wash their hands of it. (You should have given the retailer the first opportunity to sort it out. Of course, if you went to the retailer first and they advised you to go to the manufacturer, it might be different...)0 -
I went to the retailer first they agreed it was faulty and carried out the repair they have now recollected the tv for inspection0

How long before you went to the retailer did you buy it?
(And - sorry to be pedantic - did you have an actual "warranty" that they fixed it under, or did you just bring it back to them and they fixed it?)0 -
Yes, as they've had an attempt at fixing it you should be entitled to a replacement or a refund. However, the retailer get's to choose which and they're also allowed to reduce the refunded amount based on how long you've had the product (basically reduce it for how much use you've got) - there is no fixed rate for doing this, but sometimes it's done as a proportion of 6 years. (i.e. if you've had it for 3 years they'd give you 1/2 back).1

If the retailer has already had one failed attempt at repair, can't the consumer insist on a refund (less a reduction for use)?

After 1 failed remedy (repair/replacement) you'd be entitled to exercise the final right to reject for a refund (or seek a price reduction). As above the refund can be reduced to account for ownership after 6 months. The trader can not refuse this.Woodyzapp said:Am I entitled to ask for a refund or replacement rather than another repair
There isn't any obligation for the trader to provide a replacement after 1 failed remedy but there's no harm in asking
