Pete has beat me to it, OFT guidelines state the above, they cannot ask you to borrow money to pay of the debt.

There are a few letters that migth be handy.

    1. Prove it letter - Send it to see who the debt is from, for how much, why they think you owe it. If they can't prove it they can't enforce it.

    2. If you think it is nearly 6 years old, will be worthwhile sending out a statute barred letter, debts over 6 years are not enforceable in court. Check your credit file free with Experian or Equlifax, and see if there is a default on her file within the last 6 years.

    3. Send out a CCA Request, if the paperwork is missing or faulty, it once again cannot be enforced in a court.

    4. In addition, if the phone calls are becoming to frequent or you wish them stopped, send out a Telephone harassment letter, this post also contains details on how to use the Data Protection Act 1998, to remove your phone numbers from there system, so they only send letters to you. If they fail to do so, you have right to complaint to the OFT for mistreatment, and ICO for breach of data protection.
Although no trees were harmed during the creation of this post, a large number of electrons were greatly inconvenienced.

There are two ways of constructing a software design: One way is to make it so simple that there are obviously no deficiencies, and the other way is to make it so complicated that there are no obvious deficiencies

This company has sent a text to my house phone today asking me to ring them on an important personal matter. Thing is the house is brand new and we only got the phone line connected an hour before! We don't have any debt we aren't dealing with so are they just phishing? Alao, they didnt use a name, they said "you need to call..." Any advice would be appreciated. I don't want them to start harassing us just because they found out the number has been assigned.
  • Personally, I would ignore them, as soon as you speak to them you will probably get more calls.

I would contact your phone provider and explain that you are receiving nuisance calls only an hour after being connected and you either want a new number, or for them to block it free of charge.

  • Hello, around 2 years ago i to had the same problem from fredrickson international, they are extremely rude and dont seem to take into consideration that each case they deal with is individual (which is surely there job) anyway ...

as u have already signed up to experian this is a good thing because you can now see when and where the debt is from.
if it is from 5 years ago then acknowledging the debt may not be the correct move as it can get written off after 6 years.(maybe get more advice from more experienced members on that)

in my case with nat west bank i refused to deal with f/i as they are so rude and when i found out where the debt was for (nat west) i contacted them directly and explained to there collection department that i would deal with them only! the problem with these companies is people become scared of them and i can personally say stand your ground .. if you can afford to pay monthly/weekly payments offer it them but only offer what you want and can afford. do not let them bully you. jus repeat the same i can afford X amount.

nat west accepted my payments and i didnt have to deal with f/i. so i would say contact whoever the debt is from.

im new to this forum but hope that has helped.

You can ask Fredrikson International for all details of the 'alleged debt' including a true copy of the original signed consumer credit account (without which they will be unable to pursue the 'alleged debt').
However, as you say, this debt is at least five years old, it may be covered by the Limitation Act, which states that, providing a debtor has made no payments towards, nor acknowledged in writing, a debt for a period of six years, then that debt is 'statute barred' and can no longer, once the debtor has stated that he/she will not be paying it as it is statute barred (the ONLY reason needed), be pursued through the courts.

    Have a look here:

    http://www.nationaldebtline.co.uk/england_wales/factsheet.php?page=25_liability_for_debts_and_the_limitation_act

    Good luck

Yep! I did just that. Frederikson eventually wrote and told me matters were on 'hold' while they sorted out a copy of a CA for my perusal.

That was 3 months ago and so far I've heard nothing more.

    Sorry to thread crash!
It might be that your telephone number's been recycled. We moved into a new build last year and BT had to put a new line in. We've been having telephone calls asking for Mr Singh/Mrs Suman/Jyoti ever since!
