Parking eye

Hello all,

My partner has recieved a parking ticket from parking eye. This was in an Aldi store. 

She's only told me about it about two weeks ago I think and has now recieved an LBC that's only arrived this week. I don't believe she ever recieved the first letter, just a reminder and now the LBC. 

I contacted them (Aldi) yesterday and this morning and they've told me it's too late. The one I spoke to yesterday was really good, tried his hardest to sort it but couldn't. The one this morning has said it's too late for Aldi to intervene. 

I'm trying to follow the advice on the forum and sticky thread but a bit confused. I know Parking Eye is an exception. Can I request a SAR through their data protection page? I've got pictures of their reminder letter if anyone needs that posted.  

I'm sorry for yet another question on here which you regulars to get annoyed at. My partner has taken a picture of the parking eye information board. Thing is, she went shopping in Aldi that morning and it shows it went out of her bank that morning unfortunately. 

We're under a lot of stress at the moment, this is the last thing we need. So please be patient as I will try and get my head around it.

    It isn't too late for Aldi to cancel this as you only have a LBCCC.  They could have sent an email. Insist they try. It is only one email for them.

    As for response, the NEWBIES thread tells you all about how to do a last gasp dispute for a Parking Eye LBCCC.  In the 2nd post of the sticky thread, it is specifically covered that you can do a late 'appeal' to the enforcement email.

    The person I spoke to yesterday when I asked him said he would send an email to Parking Eye for me. Like I said he was really helpful last night.

    Got a receipt over £30 from that day, or bank account history of Aldi as a regular payee for months/years?

    Attach that to your email to the Enforcement team and PE will cancel even now.

    You can but there's no template. Just word it as you would normally, attaching your proof of patronage. There are no special words to use.

    It's a formal email so not 'Hi' nor 'kind regards'!

    As an aside - I don't think we have ever seen a PE/Aldi case go to court (despite LBCCC 'frighteners'). We guess it's because Aldi don't want their customers to be sued. So I'd try to put that unlikely possibility to the back of your mind. 

    Aldi HQ have their own parking team and usually an email to them with a copy of the receipt (or cc/bank statement) for the day sees a positive outcome. Try your local guy first, but if no result, go the HQ route. 
    Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

    My partner wrote a very detailed letter explaining why she overstayed on the day to Aldi. Should I be including that in there, so it's the same thing both people are getting?

    Aldi have said they can't find any parking charges on their systems.  But when I check on parking eye website, we can see it. 

    Aldi said we need to appeal first before the parking management team will only be in contact if they're unable to cancel the charge.

    Here's my email, I'm sure it's not great but any help would be appreciated. 

    Dear Sir/Madam,

    I write in relation to PCN reference number.....

    I dispute your 'parking charge', as the keeper of the vehicle. I deny any liability or contractual agreement and I will be making a complaint about your predatory conduct to your client landowner.

    I am asking you to formally cancel this. I will be contacting Aldi about this and disputing this PCN. I am the registered keeper of this vehicle and the driver on the day was suffering very badly with their health condition, hence the reason why they overstayed. They lost track of time as their breathing wasn't good and thier mobility wasn't good either. They went to see her chiropractor that day which is nearby. Map attached. 

    Unfortunately, I am not able to find the reciept for the day in question. The driver is a regular customer with Aldi and screenshots are attached. On the day in question I did shop at Aldi and screenshot of my bank account is attached.

    Can you perhaps try and re-phrase that bit?

    At the moment it looks like the writer is claiming to be the Registered Keeper of the vehicle and possibly the driver too.

    One idea might be to change it to something like...
    I am the registered keeper of this vehicle and I need to tell you that the driver on the day...

    Someone with a chronic breathing and mobility condition can't be accused of overstaying. The fixed time can't legally bind a person who meets the definition of disability and needs more time to go about daily life sometimes.

    The complainant needs to be calling this out as discrimination under the Equality Act 2010 and requiring that the PCN is cancelled and that the VRM is added to the exempt list, so no PCNs can be sent in future for taking longer to shop.

    Attach evidence of the medical condition and call this discrimination.
