If you sell you’re going to have to declare a dispute anyway, are you not, if the deeds show one thing and the situation in practice something else.
This is true, it’s just soul destroying, I might be dramatic but it feels like we have no control over our own house.

Landlord isn’t interested, ASB person initially was very good and helpful, but now reluctant to get involved again.

Unfortunately, you'll have to do something that's probably not your natural inclination, OP. You'll have to become a thorn in the side of the Landlord and the ASB officer. I'm sure that, like most reasonable people, you don't complain needlessly but you need to recalibrate your tolerance for your neighbour's shenanigans and start to report every single time they commit any act that is antisocial. Every. Single. Time. Report, report, report. Don't let them get away with anything. There's already a dispute about the fence, so you'd have to declare that anyway if you did decide to sell, and to be honest if asked about any other issues with neighbours so don't let that put you off. Be aware also that if you report an incident today, then nothing for several weeks/months, it doesn't look like a pattern of ASB, it looks like isolated incidents. Isolated incidents which aren't very serious will be quietly closed with no action. It's far harder to close 27 incidents of ASB over a two month period, even if none of the incidents are very serious.

I'm astonished at the response from your solicitor and wouldn't hesitate to get an opinion from another solicitor if you can. Again, the dispute about the fence already exists so I don't understand what boat you would be rocking by asserting your legal rights.

If the ASB officer doesn't respond to your reports or their response is unsatisfactory, contact your local Councillor. It's what they are elected to do, help constituents in dealing with issues. Your local Council will also have a Complaints process, which should be available on their website, so follow that, too if you get no help from the ASB officer.

Police certainly shouldn't be involved in neighbour disputes unless at any point you feel you are at risk of physical violence or threats of physical violence or damage to your property. I'd certainly suggest you record all interactions with the neighbour but I wouldn't do it overtly in case that exacerbates the situation. You could ask to speak to a local PC/PCSO to flag your neighbour's behaviour, just to make sure there's a record of your concerns in case you need it in future to show a course of conduct by the neighbour that might constitute harassment.
You should be able to find contact details on your local Police website.

To repeat, OP, report, report, report. Every. Single. Time. Make it difficult for the Landlord, ASB officer and anyone else to ignore you. Make it easier for them to do something to deal with the neighbour than with your constant reports.
I can’t thank you enough, you have actually given me strength to continue, I was feeling so down trodden and was feeling maybe it’s just me!

Thank you so much for your wise words and I AM going to continue, this is my home and I can’t give up.
Good for you Rayray. It's easy for me to say but not so easy for you to do, but I've been subjected to antisocial behaviour from a neighbour and over time it really grinds you down.

Stay strong, feel free to vent here if you need to and remember - report, report, report!

What are the laws in Scotland, because if you and the landlord both 'equally' own the garden, the landlord, by allowing the fence is denying you access to your property.
It's just further digging you can do to help because pain in the correct way.
May you find your sister soon Helli.

As far as I know you are correct.

I still have access as such as the gate isn’t locked but it feels very uncomfortable going to the other side of the fence. I have been over once to see my roof space after a really strong wind and I felt like I shouldn’t be there and to top it off stepped in dog dirt!!

Get C5 involved - don't they have "Neighbours From Hell" type reality shows? At least the world will know what your antisocial neighbours are like. It may be that a public shaming has an impact.

    YES YES YES. DO THIS.
These folk will only respond when they are confronted with authority and realise the game is up. They have no empathy, so will not 'come round' from any sense of decency. They are pathetic human beings.

If the AS dept of the council drag their feet, then escalate it just as Jude says; your local councillor, or the head of the department. INSIST. DEMAND.
If there are actual threats, then DO involve the local police. If they drag their feet, then ESCALATE up the chain, and ultimately to the Area Commissioner (PCC). Pester your MP.
Anti-social behaviour destroys your rightful enjoyment of your home and life. EVERYONE knows that it's hell. NO-ONE should trivialise it.

Turn the balance of power around, RayRay - do NOT be intimidated by these bullies; think about it - apart from pathetic attempts to intimidate, what CAN they do? They are EXTREMELY unlikely to actually physically approach, threaten or engage with you, because that is such an obvious line, and they'd KNOW they'd then be stuffed.
You can buy effective pocket recorders on eBay for around £13. Have one on you whenever you are in a situation where you might come across them, and you behave with calm reason - let them hang themselves (metaphorically). I promise you - this works. I know.
    Good luck.

Just an update… I had been very down trodden and defeated the last few weeks due to neighbour & family painting what they class as their side of the fence… the side that faces me was left in a mess, but never mind. There shouldn’t even be a fence 🙈

That same day we had to endure more or less every curse word  under the sun. I’m no wallflower but it was disgusting & embarrassing the way they behaved.  I must add this wasn’t directed at us but this was their conversation of a 3 hour period.

We endured it as if we wanted to avoid would mean we simply had to leave the house and I had an unwell child.

I am going to demand a face to face appointment with the Environmental Officer regarding dog dirt.

Whether or not I should approach the LL is questionable as it’s down to them the Tenant continues to behave this way but I will persevere and I’m hoping for some kind of resolution so I am just going to become a pain to them!

Sorry to say this but it sounds like your relationship with you neighbour is irreparably damaged. You dont say what has caused your neighbour to put this fence up or call you nasty names. I suspect it is the result of earlier trivial complaints and it has now escalated, so much so the neighbour has gone to considerable effort and expense to separate themselves from you. It is never going to get any better unless you put it to bed, the neighbour knows you are doing your best to get them thrown out of their home and they are never going to love you. You can wage your war against them and let it consume your life or you can just ignore. If its that bad, paint your side of the fence and if you still feel the same way, move.
