The other week my daughter met colleagues in a pub for lunch and the party were using five cars. My DD wasn't driving but is a driver. They had a nice lunch and then went to go back to their cars. DD noticed a sign and read it even though she was a passenger, and sent all five drivers scurrying back into the pub to exempt their VRMs on the keypad no-one had bothered to point out to them. Not a single driver had seen the signs because people don't expect this sort of thing (except if you are in the know).
Anyhoo, my DD deprived the PPC of £500-worth of PCNs just by reading the terms - I was a proud Mum!4 -
Yes. If she had to rescue every driver in her group, then I imagine the entire pub/restaurant customers are regularly caught.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

She (her son) is a disabled badge holder, but her failures to address these parking issues in a timely manner are probably a combination of not being fully aware of the state of private parking and how bad it has actually got in last couple of years; Covid; perhaps being under the false impression it would all just go away if ignored; and perhaps daily stress she has had with family/relationships and documents being served at an address she was not frequenting too much at the time - thereby being overlooked. Now however - she is extremely aware of the cameras on the poles and is even afraid to enter anyones drive to do a 3-point turn
I think I have managed to instill the fear of god into her about checking everything everywhere - even if it means taking your eyes off the road and having a collision

So for her Stanmer Park NTK issue, she has received the Claim form from OPS/DCB Legal Ltd on 28th July - which I've acknowledged on MCOL today for her.I've perused the somewhat excellent defense templates here and will be using these when the filing time is due.1

(psssst... there is no letter 's' in the word defence.)

hahaa...sorry should have been clearer - the issue date on the claim form is 28 Jul 22.so acknowledging MCOL today would have been the 5th day (incl the weekend).0

That's four weeks away. Plenty of time to produce a Defence, but please don't leave it to the last minute. To create a Defence, and then file a Defence by email, look at the second post in the NEWBIES thread.Don't miss the deadline for filing a Defence.
Do not try and file a Defence via the MoneyClaimOnline website. Once an Acknowledgment of Service has been filed, the MCOL website should be treated as 'read only'.
Whilst of course you can help her, everything must be done in the name of the named Defendant.3 -
The pertinent points of defence is the inadequate signage at Stanmer Park as well as the the landowner authority, I understand this.I am just wondering, seeing my friend never actually revealed the Driver - the Claimant OPS is essentially taking the registered keeper to court even though Stanmer Park is public land?
How does this work? Am I missing something here and shouldn't this claim be thrown out immediately due to this anyway?0 -
Yes...unless the Defendant was actually driving and gets asked that question in court!PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Sorry I am just having a chicken and the egg moment here - wondering how they are even getting to court stage with the Defendant never having given driver details.
The Defence statement that will be filed will provide the truth obviously, but am wondering why these courts don't see the whole PPC thing as a complete and utter waste of time for everyone as it gets to court stage on a wing and a prayer for them, seemingly.
