Dunelm - is this legal?

I purchased a (cheap) pair of curtains from Dunelm's website. They charged £15 plus £3.95 delivery.

I received the curtains today and found that the curtains have a label on with a price of £12. Are they allowed to sell for more than the labelled price? I thought this is illegal under the Consumer Protection from Unfair Trading Regulations 2008.

Edit: This colour is supposed to be cream!!!!

Thanks.

They advertised them on line for £15 + p&p & charged you  £15 + p&p. Where did they mislead you?

If they'd have a price label of £20 what would you be doing?

Yes, of course it's legal. They don't need to have any price marked on stuff they've sold you online, do they?

Would be different if you had picked up the item in the shop and they charged you a higher price at the till.

    Yes, entirely lawful.

The regulations you refer to say that for a commercial practice to be 'unfair' it must affect, or be likely to affect, consumers' ability to make an informed decision about whether to purchase a particular product.

If those curtains were offered for sale on Dunelm's store shelves then that price label would be likely to influence your decision. However as Andy_L said, it couldn't have influenced you if you bought online for the agreed price without sight of the packaging.

Are you sure it's legal? I remembe rwhen I work for one of the DIY chains I had to remove a load of labels as were were told it was not legal to overprice products upwards.
  • Ok, thanks.  Just checking.

Still can't believe these are supposed to be cream colour!!!  This is the link.

For items being sold online? Why would it matter whether they've got price labels on them at all, never mind up to date ones?

Colours on line are always tricky due to the vagaries of monitor/graphics card settings.  They might be paler when you take them out the packet & they are unfolded & held up to the light

Send them back if you don't like the colour and/or think you paid too much.

It appears they offer free returns so pop it back to them if the colour isn’t suitable.

Doubt there is an issue with the prices but of course it will displease customers, perhaps not the brightest practice for a retailer, especially if also offering free returns.
