Advice for Parking Tickets issued for Parking in own Bay

    Let's get one thing straight, supposedly the management company and its agents are working for you.
    If that's how they treat customers then you should dig in and tell them to get stuffed (I would use another phrase but the forum filters won't allow it)
    From the Plain Language Commission:

    Been on the phone to the management company and the guy was just useless, felt like I was speaking to a brick wall. No wonder they have a 1 star rating online. Thinking about copying in a senior figure within the company to get some attention to the emails. As suggested I have emailed my local MP and will start getting my neighbours involved to also make them aware of this scam.

    May we remind you that you provided your personal details when you appealed the charges, we did not obtain it from any other means. When we obtain data from the DVLA we have to prove reasonable cause.

    If you are going to use forum based statements it is important that you use ones that are relevant to this matter.


    We will continue to use your data and at the appropriate time it will be passed to our solicitors for debt recovery action. A process has to be followed therefore we can not issue a county court claim at the current time however when permitted and if the charges remain unpaid our solicitors will do so.


    Any counter claim will be robustly defended and evidence of how we offered you a compromise of paying one charge and we would cancel four to settle this matter which was rejected.

    Leave them to stew now but do get your MP on board.  You own the bay and should never have been misled into thinking you had to buy a permit in order to use what your leasehold title already grants you.

    Did you tell them about the allegedly clamped vehicle?
     There are a few reasons as to why a vehicle may be clamped, such as bailiffs, the DVLA and even self clamping where someone may use it to immobilise their own car  as a deterrent .

    Your main complaint is with the property managemetn company -  as principal they are liable for the actions of their agents .
     The stuff you have from link is of course useful to show just what you are dealing with , no reasonable company would respond in such a way.

     Depending upon the make up fo the residents you could also get some publicity and a local group together to get their money back that  may have been mistakenly paid to Link , and for any "permits" and to get Link parking and prevent any other parking scum that belong to the likes of the BPA or IPC infesting the land.

    Yes, trying to trace the owner of that parking bay to find out the whole story but this seems quite hard.

    Got a response back from a caseworker on behalf of my local MP:

    Thank you for your email to Wes. We were very sorry to hear about the problems you and your neighbours have been having with your parking.

    If you do own the parking bay, it is very difficult for a private company to issue you a PCN for parking on your own land. In this case, we would strongly recommend that you seek legal advice about your options.

    Meanwhile, Wes has written to the management agency to raise his concerns and he will send you their response once he hears back.
