I don't know, but to me there's an irony in  complaining that it should much easier for everyone to return anything they have bought on a whim, while also being outraged that Clark's might sell them anything other than a pristine pair of shoes never out of the box.  What do people think happens to the stuff they return?

Purchases in Clarks are easy to return, even if the purchase was on a whim. Within their T&Cs. Same as Primark, M&S, Next and lots of other stores.
The issue is that the OP says she was sold a pair of shoes that had been worn - she says not worn by her child - and that is why the return has been refused.

I have no illusions that if I buy a pair of shoes from Clarks (or a dress from M&S/Next) it may have been purchased earlier by someone else who then decided to return them for whatever reason.
As long as those shoes are unworn and still have the tags on, I accept that.

If they are unused then I doubt I would even know they had previously been sold. However, if I return something used and faulty or damaged then I would not expect them to be re sold, probably just consigned somewhere (there are auctions that specialise in selling pallet loads of returned goods) . If these were in the state OP describes then Clarks must have taken them back as faulty or damaged - and they are unlikely to have ended up back on the shelves.

The scenario as outlined is that a worn pair of shoes was returned and somehow put back in stock room (unlikely) they were then tried on and fitted and no one noticed the wear (unlikely) and then taken to till and checked for size and again with wear not noticed...that's a lot of things going wrong.

was it a pair from a Clarks outlet or a regular shop? Outlets (at least the one near us) do sell pre-worn shoes marked down, although they do say this on the display/box.

I remember returning a pair of kids clarks shoes 3 months after bought as they were falling apart and they gave me half the money back towards a new pair.  This was the only problem I ever had with Clarks and was happy with outcome.  went on to always buy Clarks as they are expensive but built to last.  I think you need to explain what happened as we all know how hard it is to shop with young child and feel Clarks made a mistake (perhaps previous customer swopped used shoes for new Without the assistant being aware)  I often buy things that have been tampered with by customers and only realise latter.  Society has taken a turn for the worse and no thought for each other now.

The problem with that is the OP does not want the  shoes at all. She wants her money back as she thinks they were too dear.
