Claim Form UKPC Ltd Process

My name is TacoPowell and I am an idiot, heres why;

In December 2018 I was issued with a PCN from UKPC Ltd for Parking my work van in a Permit area without a Permit, through bad advice I ignored it and its recently come to a the point that I recieved my Claim Court Issued on 29 March 2022,

I quickly checked the guidence on the newbie thread and submitted my AOC on the 08/04/22, I have since been on holiday and now suffering from Flu, so as I've found myself at home with little to do but rest I figured now is the time to get this sorted,

I'm hoping I've managed to get a little extra time in the coming days to sort my defence, As said, I've had Flu, so picking up a laptop has been a struggle!

Is a SAR to late in the day? I've still got the original PCN which I can post here if it helps?

I'm far from legally minded but will give this all my best go so I can build my defence.

    With a Claim Issue Date of 29th March, and having filed an Acknowledgment of Service in a timely manner, you have until 4pm on Tuesday 3rd May 2022 to file your Defence.

    That's just a few days away. Plenty of time to produce a Defence, but please don't leave it to the last minute.
    To create a Defence, and then file a Defence by email, look at the second post in the NEWBIES thread.
    Don't miss the deadline for filing a Defence.

    Do not try and file a Defence via the MoneyClaimOnline website. Once an Acknowledgment of Service has been filed, the MCOL website should be treated as 'read only'.

    You should also send a SAR to the parking company as described in that same NEWBIES post. The response will be more useful at Witness Statement time so concentrate on your Defence for now.

    Do the SAR now, to see their hand before WS stage comes.  Wait for more advice about how easy it is to do a defence.

    Thank you for showing the issue date and the date you completed AoS, one of our regulars @KeithP will be along to give you the deadlines for submitting the defence and some guidance as to where you can find our standard defence template.  Don't think of yourself as an idiot, rather a victim.  It's never too late to submit a SAR as the data you receive will be useful at the witness statement stage.

    The following was in response to my SAR to UKPC,

    might be reading into it but feels like their looking for me to trip up/give them more than they should have.

    How should I proceed?

    "Please note you have provided us with insufficient information to identify you.

     

    As we have received your request via email, we will need to take steps to verify your identity before we can process your request.

    Please can you confirm your identity as per the following for verification purposes (if you are the keeper of the vehicle, if you are not, we would need the information of the keeper of the vehicle as well as confirmation that you are authorised to receive the subject access request documents):

     

    i) the vehicle registration number the ticket was issued against

    ii) your Parking Charge Notice reference number

     

    Once we are satisfied with the information you have provided us, we will then process your subject access request.

     

    Kindly take notice that as we have requested to verify your identity, we are obligated to inform you of the following:

    1. The reasons as to why we have requested additional information from you (please refer to the above reasoning)

    2. You have the right to make a complaint to the Information Commissioner’s Office; and

    3. You have the ability to seek to enforce your right to erasure of the data through judicial remedy and processes.

    My earlier suggestion remains...
    that you forget about sending a SAR until you have filed a Defence.

    You have a fixed deadline for filing a Defence - a few days away, but you have several months before a SAR response will be useful.

    When the time comes, a copy of your County Court Claim Form would be suitable confirmation of your address. UKPC were happy to use that address to file a Claim.

    1: A copy of your V5 .... they already have your address so that confims who you are
    2: Maybe a redacted copy of a utility bill

    BIG NO NO TO A PASSPORT OR DRIVERS LICENCE

    The private parking industry in all their forms ..... CANNOT BE TRUSTED

    I no longer own said vehicle so i might be able to fish out the handover receipt slip but thats it

    Just send them copies of a couple of redacted utility bills to confirm the address you are living at, plus a copy of the court claim form. That should do the job. No need to chase any shadows trying to find an old V5C handover receipt. 
    Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

  • Okay folks, So I've brought up a tabs on chrome from searching "Claim defence no permit"

    I'm going to be honest, the legal language absolutely fries my brain! but I'll persevere,

    I'm struggling to find a case Umkomaas said:

    When you say redacted, I'm assuming I need to blank out any sensitive information bar my name and address, would an online statement be sufficient?

    But you aren't going to get anything back from a SAR before your Defence filing deadline.

    Your Defence filing deadline is five days away. Those five days include a Saturday, Sunday and a Bank Holiday.
    Are you really expecting a parking company to respond to a SAR within two working days when the law allows them a calendar month to respond?
