Don't forget to include that loading and unloading (passengers, shoppping etc etc) has been deemed by the courts as not parking. Also under Disability Rights PPCs are supposed to make allowances for people with disabilities who in this case were being dropped off.2

How to claim costs, expenses etc
I'm preparing for different eventualities, including BW Legal withdrawing at, or before hearing - or them losing.
I understand I can then ask for up to £95, but am unaware of the process. Please can someone advise me on how to do that? Is there a guide / example / template covering this? Thanks again.0 -
It's already in the NEWBIES thread.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Greetings. What is the web address where I can input my case number to check if claimant has paid the hearing fee before the deadline? Can't find it online or amongst my papers and it's driving me mad! Thanks0
-
There is no such thing. You can't check unless you just phone your local court, and you should proceed assuming they have paid.
This is over a year after you last posted in May 2022, so have you got a hearing date?
Done your WS & evidence bundle yet?

Even if claimant hasn't paid and case is struck out, they will claim it is a CCBC/CNBC error and case will be reinstated.1

Thanks, emailed court service in the end and they helpfully told me fee was paid on time.
WS & evidence bundle not done yet but I'm ready to produce same based on the 2019 template recommended here and my account as stated in Defence filed a year ago.But I know there have been changes but no idea what to do about them or of impact on my case.
Hearing date is October 12 for in-person hearing and statements must be exchanged on or before September 28, seven days hence. But Claimant has not supplied their statement, presumably intending to go to the wire on that.
Imagine I can only prepare a statement based on the skimpy content of the Claim Form of April 2022, which is all I've had from PPS / BW
LEGAL, apart from a letter offering me a 25% discount to settle and another last week suggesting I phone them out contact them via their (debtors) web page.0 -
WS & evidence bundle not done yet but I'm ready to produce same based on the 2019 template recommended here and my account as stated in Defence filed a year ago.2019 is too far in the distant past. So much has happened since then. The following Witness Statement is the very latest seen as a good example from which to work. Use it as the basis on which to construct your own. Note - this isn't suggesting you just copy and paste it, you must describe the circumstances pertaining to your parking event. Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

But there is now a bit more to add to that one!
Go read the defence by @xavian1234 and grab the four judgments and the extra wording, which will nicely slot into a WS.
Best if you get yours filed and served BEFORE theirs (usually) because yours will be suggesting to the Judge that the claim should be struck out due to woeful template POC. If you wait to get a 50+ page full bundle with photos from the C it diminishes that argument.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
