Typo  -  "....contract by paying, but the (claimed) failed to comply...."  -  (claimant)
Thank you.. I was wondering about that.. changed  ;)
  • Question - Can you use someone who was there at the time of alleged offence as a Witness?  Just I was meeting up with a group of people and one of the members waited for me at the car park enterance so witnessed all that happened.

Yes, but that comes later, if you are only at defence stage.

The first 12 steps, including the first court form that follows, are in the Template Defence thread.

Later procedures are in the NEWBIES thread under the red heading in captals.

I have recieved a Claim Form from the County Court Business Centre dated the 31st March and filled in the AOS by the 18th April so by my reckoning I have to submit a defence by the 2nd May.
2nd May is a Bank Holiday.

With a Claim Issue Date of 31st March, and having filed an Acknowledgment of Service in a timely manner, you have until 4pm on Tuesday 3rd May 2022 to file your Defence.

That's a little over a week away. Plenty of time to produce a Defence, but please don't leave it to the last minute.
To create a Defence, and then file a Defence by email, look at the second post in the NEWBIES thread.
Don't miss the deadline for filing a Defence.

Do not try and file a Defence via the MoneyClaimOnline website. Once an Acknowledgment of Service has been filed, the MCOL website should be treated as 'read only'.

Thank you clarifying that for me KeithP.  I'm preparing my defence with the help of the good people on this forum and should be ready on time.
  • Hi
I have recieved an E-mail today from DCBL collections letting me know that I Park Services have instructed them to "Cease Debt Recovery action for this matter"
Is this news as good as I think it is or do you think I Park might use another company instead of DCBL?
I don't want to celebrate too early  :)
    Many Thanks

DCB Ltd are powerless debt collectors. Whether they stop sending out bog paper has no bearing on a PCN or court claim via solicitors.

    DCB Legal are solicitors.
    DCB Limited are debt collectors.

This sentence in that letter is important...

As @Fruitcake says, this is just a debt collector giving up.
Don't start celebrating yet. The parking company has up to six years to pursue a claim through the courts.

This OP has a claim, so must defend. Nothing has changed.

DCBLtd (not Legal) were never anything to do with that claim.
