Possibly mention it in passing but you don't attach anything to a defence.  Evidence comes later.

Sorry I meant in my witness statement? I have found quite a number of people online complaining that this car park is run by crooks.

Your Daughter just does a simple one, supporting what you say & confirming it.

Your one can be copied & adapted in hours, from the example WS bundles by @Daiapolon2021 or @aphex007
    As above then.

Should be easy to copy & adapt and yes you could append that review section as an exhibit (but it is just anonymous people = hearsay really). Not a silver bullet.

  • Sorry if I'm being dumb, but it doesn't seem to be very clear as to where I send the witness statements to. I assume its the court where the hearing is taking place right? Can the statements be emailed across or do they have to be printed out and posted/handed in?

The WS goes to the court where the hearing is to be held, even if it is a remote hearing, as well as to the claimant.
    Email is fine.

If you don't have an email address for the court you chose then you should be able to find it using a search engine of your choice.

And of course copy in the Claimant's solicitor!

This is already covered in the WS & evidence section of the Newbies thread but don't use the out of date RobertCox WS example there.

The NEWBIES thread 2nd post has a whole section headed in red capitals: IMPORTANT: KNOW WHAT HAPPENS WHEN and a link to a 'Court process' thread by bargepole.  The NEWBIES thread is your end to end resource.

  • Hi there,
Just to update, I had my court hearing today but unfortunately lost.
Although the judge did agree the signage wasn't great, apparently it was acceptable... just.

I just want to pay off the costs and be done with it all, but not really sure how. Do I wait for them to contact me, with the final amount?

    Thanks for the update.

That is a shame to read but these cases are mainly about the clarity of the signs and once a Judge decides they are adequate, sometimes it is then about damage limitation and arguing against the added £70 fake DRA fee.

Did the Judge remove that at least?

If you know exactly how much was ordered to pay, then pay it on the solicitor's payment portal. If unsure, ring the solicitor and pay by card.

    Don't wait.

  • The Judge removed some charge, possibly that and denied the interest they were trying to add. In total I have to pay £212. I feel the judge was as fair as he could be, but for someone like me who has no expertise of the law and was just trying to fight for something that was morally wrong, I don't feel like I had much hope!

My daughter who was my witness, didn't even get to speak, which she was very disappointed about.

It has just left me feeling that justice has long gone out the window for most people, and the only lesson I can pass onto my children from this is that its good to fight for what's right, but it won't get you anywhere, other than having the satisfaction of trying!

Thank you for all your help though and I know some people are successful in fighting these bunch of toads!
