Doesn't your County Court Claim Form have your name and address on it?
Send them a copy of that as proof of ID.
Can't get better than that... that address was good enough for them to sue you.
  • Update on my case -

I have just received my SAR from Highview; inside the folder provided is the original charge and a second letter telling me to not ignore it, that's all they've been able to provide.

Is there anything else I should be doing with this? I submitted my defence on Monday via the email address and received an automated reply but that's the last comms so far.

    Dear Sir/Madam,

    Thank you for your correspondence.

Please find attached copies of the requested documents.

We can confirm that your name and address details, along with details of the outstanding Charge, were passed to Direct Collection Bailiffs Ltd who are our Collection Agents on the 17/06/2020 respectively for the purposes of recovering the outstanding amount on the Charge.

You are able to find more information relating to how we manage data on our Privacy Policy which is located on our website: www.groupnexus.co.uk/privacy-policy.

    Yours faithfully,

  • Just had a letter from the Court arrive too in the post.

Received my defence and a copy has been sent to the claimant, they may contact me directly to attempt to resolve the dispute. If the dispute cannot be resolved informally, the claimant will inform the court they wish to proceed.

Claimant must contact the court within 28 days to proceed, the only action the claimant can then take will be to apply to a judge for an order lifting the stay.

So 25th April I had a reply back as per this thread, since then zero has come through in form of post / email.

At this stage should I have submitted a WS? or when am I likely to have any news?

A court order will give you the date of your hearing and either a specific date (if earlier) or 'within 14 days of the hearing' for the submission of your Witness Statement.
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

If you are following the guide to court and the twelve step procedure from the defence template sticky thread, then you should be looking out for the N180 form that you fill in to tell the CCBC in which court you want the hearing to take place.
Only use the N180 sent by the courts, or one you have downloaded. Never use one received from the claimant.

You can start working on your WS any time you like, as well as your evidence/exhibits, but you will be told by the court you have chosen when and to whom you must send it.

Thanks for the replies, am I right in thinking if the claimant doesn't reply I'll automatically win before it hits court?

Doesn't reply to what?  There's no 'automatic win', nothing's that uncomplicated.
