If he paid for it using the BBLS then his company has debts which almost certainly outrank your claim.Okydoky25 said:
I’m aware he has a van which I assume must be in the company name as he paid for it using the Covid scheme available to businesses.Olinda99 said:Get the judgement bumped up to the high court bailiffs asap and get them to enforce (assuming the company has any assets,)
eg https://dcbltd.com/debt-recovery/Lots of tools. Would these be classed as company owned. I’ll take a guess he paid for then through the company.1 -

It is an offence to make a dishonest application - you can face a fine and possible prosecution.

You could only have bailiffs seize the van if he owns it outright. If on finance, it's not his.No free lunch, and no free laptop

To be honest i'm resigned to not seeing my money but if it stops him just shutting up shop and walking away with his assets only to start up again then ill do all I can.

It's highly likely the assets have already been transferred out of the company. Even if that hasn't been done legitimately, it's going to be very difficult for you to prove it.Okydoky25 said:

Ultimately accounts will need to be produced.user1977 said:

...or else the company gets struck off, which is what they're already trying to do! Unless the sums make it worthwhile, there isn't usually much point in other parties trying to investigate what's happened to the assets.Thrugelmir said:

It will only delay the process rather than stop it.Okydoky25 said:

They have another company they tried doing the same with but that says striking off action was discontinued.gettingtheresometime said:

I’ll take a guess he paid for then through the company.Cause has been shown why the above company should not be struck off and the above registrar is taking no further action under section 1000 of the companies act 2006. Their accounts are well over due as well. They never register any accounts on any other the businesses it seems.0 -
If it is insolvent, it may not be as straightforward to simply get it struck off. There are rules in place to limit companies ability to do a moonlight flit owing a lot of money. If you are asked, point out the company is possibly insolvent. You are resigned to not getting your money back but that won't make his life any easier.May you find your sister soon Helli.
