Gifted Items in tenancy

Hi if anyone is able to give me some advice please , we moved into a property last month and was told all the items were working fine and no issues , however the integrated hob and oven plus the dishwasher was gifted and will not be repaired. There were no issues and were all working and nothing was said. Upon entering the property the integrated hob dosnt work correctly and only has one working ring , however they are now saying its gifted. We explained that under no circumstanced if we were told that this and the fire did not work we would not have taken it as i didnt want to pay over 500 to have the integrated hob and oven replaced , but they are saying its not there responsibility to tell us . I cant afford s replacement as its a full kitchen , it means for me i need to bu a cheap cooked and cut a slot. in the kitchen to place it in and the landlord says no . Any advice?

    You could pick up any type of cooker or hob for £10 or less at your localauction......

    So you are a tenant and renting a property from your new Landlord ?
    Is the dishwasher one you can pull out or is it fitted ?I
    If " portable " it should be PAT tested !
    What about the EICR that a Landlord must provide to prove the Electrics are safe and in full working order.
    An EICR lasts 5 years 
    So you have a copy of the EPC, Gas Safe Certificate , and EICR ?
    Report in writing that the fitted hob and oven are not working and ask how did the property pass an EICR with defective and dangerous electrical appliances.
    You also talk about a " fire " Electric or Gas ?

    So the hob and oven are yours "gifted"

    So buy new ones, and when you decide to vacate, take them with you.  The LL cannot complain as they (according to him) were always yours to do with as you please.

    It seems strange to me that integrated appliances can be classed as "gifted". Freestanding ones, yes - but surely integrated ones are seen as fixtures. Can fitted wardrobes and electric showers be "gifted"?

    The hobs a weird one, Assuming its gas it would need to replaced by someone qualified.

    Im guessing its just a way of the landlord not having to repair/replace

    Problem is you agreed to take the property with these items as gifted.

    Now they are broken you don't want the responsibility or replacing them. But hats what you signed up to 

    I appreciate you thought they were working but did you check?

    If gifted this should be documented somewhere (inventory as gifted to customer) or excluded from the tenancy/inventory.

    An EIRC is a snapshot on the day. Like an MOT. Wouldn't pick up a broken gas hob. Gas cert should.

    Why do you need to replace the oven? You haven't said that's not working just the hob ring?

    You can get gas or electric hob for £70 at currys. 

    £129 for an oven if needed

    - If this was at the point of signing the contract, then that's what you agreed to
    - If this was when you moved in and saw the inventory, then you can argue its not as advertised / agreed ie with a hob and oven included in the LL repair obligations.

We explained that under no circumstanced if we were told that this and the fire did not work we would not have taken it as i didnt want to pay over 500 to have the integrated hob and oven replaced , but they are saying its not there responsibility to tell us . - well its not.. if you agreed to a gifted hob, that's the equivalent of no hob in the property, and you should have proceeded on teh basis of buying your own. Anything extra would have been a bonus. 
    I cant afford s replacement as its a full kitchen , it means for me i need to bu a cheap cooked and cut a slot. in the kitchen to place it in and the landlord says no . - well you can ask them to remove their gifted items, as you don't want the gift. That might make space for you to get your own free standing hob / oven or at least mean you have the work half done to replace with your own?

    Key is when you were told this
    1) IF it was at the point of signing the contract, then you agreed to taking a property with no hob or oven included. You should have budgeted on the basis of providing your own and not taken the property if that wasn't affordable. 
    The gifted items are at best, a bonus, but they have no obligation to tell you anything. Arguably you can reject their gift and ask them to remove.. that might give you more space or a slot to install your own items. 

    2) IF it was at the point of moving in / in the inventory, then you can argue the property is not as described, whereby the LL's repair obligations would include any fixtures and fittings unless specifically excluded (I'm assuming this wasn't specifically excluded in the contract). The tenancy continues, but you can ask them to remedy by providing working items or eventually buy your own and claim the cost as damages.
