Plan A is always for the keeper to complain the the landowner, assuming an occupant of the car or the keeper is/was a customer.
so should i still complain to the landowner?
seeing as first I've heard was the court letter?
And yes i was a customer in the shop
Also found a better picture of the "signs", marked sign 1 is supposed to read while driving and only seen if approached from road heading towards it
And sign 2 if I remember rightly never used to be there as I lived in the area for 5years and used the shop quite a lot.
Also found that you were only allowed 45mins to shop!!!!!! It used to take me that long to walk up the stairs with having mobility issues0 -
Why would you want to help prove the PPC's case for them by providing those images?
If a motorist arrived with the shop on their left, there are no signs visible to the driver.
A service provider is required to make reasonable adjustments for customers with disabilities described as protected characteristics as defined by the Equality Act 2010. Failing to do so beforehand could be classed as indirect discrimination.
Continuing a case once they have been informed of a person's disability could be classed as direct discrimination once they have been made aware of this.
Allowing more time for someone with a disability would be classed as making reasonable adjustments. Failing to allow more time for such a person would be discrimination.
This failure to comply with the EA 2010 should feature in your complaint to the landowner, and in your defence.

Yours is slightly different because you stayed and shopped, but here is a defence today, where I advised someone how to word a paragraph about the legal right to extra time for people with mobility of other disabilities:
https://forums.moneysavingexpert.com/discussion/comment/79114784#Comment_79114784
You were legally allowed more time as a 'reasonable adjustment'. Not 3 hours (that's a Council 'on-street' double yellow line allowance, not relevant to car parks). But an adjustment of extra time IS required for people like you:
http://news.bbc.co.uk/1/hi/uk/8488737.stm
The above article even pre-dates the EA (the old DDA no longer applies) but still nothing has been done by most retailers. However, the EA law requires more time where needed, otherwise it's indirect discrimination.

AoS was submitted yesterday 05/04/2022.With a Claim Issue Date of 29th March, and having filed an Acknowledgment of Service in a timely manner, you have until 4pm on Tuesday 3rd May 2022 to file your Defence.
That's over three weeks away. Plenty of time to produce a Defence, but please don't leave it to the last minute. To create a Defence, and then file a Defence by email, look at the second post in the NEWBIES thread.Don't miss the deadline for filing a Defence.
Do not try and file a Defence via the MoneyClaimOnline website. Once an Acknowledgment of Service has been filed, the MCOL website should be treated as 'read only'.1 -
thank you everyone for all the advice and help given, I'm getting on with it all this morning
KeithP and Coupon-mad once done I'll show you what I put in as my defence when completed and before I send it.
And Fruitcake thanks and yes I totally know what you're saying I was pointing out the "new" sign on the wall as I know it wasn't there before, in fact saw an old Fb post from 2015 that mentioned it used to be in the hedge at the back of the car park and foliage had grown over it.
again thanks everyone1 -

Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

We trust after reading around a bit on this forum, that you are aware that the statutory Code of Practice (that will regulate the PPCs and DRAs - both of them) is temporarily stalled?
And that we are calling on ALL victims to help...
We sincerely hope that you are au fait with the need to respond to the final Government Public Consultation to join our push to get it over the line.
Hopefully - amongst all the political disruption - it will be open later this year and into January.
If PPCs manage to turn around the decision on banning the gaslighting / claim-funding 'fees' then the DLUHC will be rubber-stamping £200 parking charges and if that happens, they (Government) and the PPCs will wreck high streets and people's lives. Whoever is responsible, if that happens (and it very nearly did in 2021) must hang their heads in shame.
Just checking you are among those ready to respond to the questions as you have personal experience of how this crap of £170 eye-watering demands actually feels?
Please come back here when it opens, and you can make sure you don't miss the Consultation:
If you are not likely to be a regular reader in the coming weeks/into 2023, to be alerted you'll need to bookmark the thread by MSE_JC at the top of the forum and enable (on your profile) email alerts for bookmarked threads.
