County Court Claim - Highview Parking

I have received a CC claim form today for allegedly contravening parking in July 2020.  The vehicle registration they have quoted (a personalised registration plate) does not belong to me nor have I ever owned or been the registered keeper of vehicle.
I have , as directed on the claim form, used mcol to respond and fully defend the claim. Is there anything else I should be doing?
Thank you

I have received a CC claim form today...
What is the Issue Date on the County Court Claim Form?

The vehicle registration they have quoted (a personalised registration plate) does not belong to me nor have I ever owned or been the registered keeper of vehicle.
Then how did they get your name? Is this a hired or leased vehicle?

I have , as directed on the claim form, used mcol to respond and fully defend the claim. Is there anything else I should be doing?
Does that mean you have filed an Acknowledgment of Service?
If so, on what date did you do that?
You didn't write anything in the Defence box when doing that, did you?

Did you put anything in the MCOL defence box? I hope not.
What was the issue date on the claim form? You may have jumped the gun a bit by doing the AoS straight away, but it shouldn't make too much difference.

Contact the DVLA in writing to get confirmation that you are not, nor have ever been the keeper of the vehicle with that VRM.

Complain to Highview/GroupNexus and the BPA about this vexatious claim. Send an SAR to the DPO of Highview as per the NEWBIES asking them to supply you with all personal data they hold about you.

    Complain to the landowner.

    Complain to your MP.

I stated that I fully deny the claim - should I have not ?
Did you write that in the defence box, or did you just tick a box to say you fully defend the claim?

Whatever you write in the defence text box, even if it is a single full-stop, becomes your defence. It should be left blank, then the defence emailed to the CCBC later.

  • I had a previous battle with them last year regarding another alleged parking matter ( they had sent all correspondence for that one  to an old address and claimed they had checked the electoral registers and DVLA that I lived at the address - when I hadn’t for 3 years)  and proved it on a court call.
I am presuming that because my name (which is common) was known to them, they just issued a claim.

I stated that I fully deny the claim - should I have not ?
And where exactly did you state that? In the 'Defence and Counterclaim' text box?

Hopefully not, as that will be taken as your full Defence.
  • Sorry, the claim form was received today and I responded on mcol this evening.

Yes, but we need to know if you wrote anything in the defence text box.

To get the maximum time to write a defence, you should wait until day 6 before completing the AoS, however if you have written anything in that text box, then that is your defence.

Basically did you 'start defence'?  Don't...
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
