As a landlord, I am trying to get deposit back from TDS - should I go to small claims

Because getting money out of the custodial schemes is hard work if the tenant does not reply or simply refuses to agree, because why would they if you are taking all the deposit for arrears etc. Sometimes you have to get a solicitor to sign a form to say you can't get hold of them!theartfullodger said:

I cannot imagine why any landlord of sound mind would even consider not holding on to the deposit themselves and paying £20 or so for insuring it in the deposit scheme..............
The insured scheme you hold the money so you can tell them of the deductions, give them reasonable time to dispute it with you or the insured scheme and then if there is no contact you can basically assume it's yours.
It's a no brainer for £20.0 -
