Judgment for Claimant (In Default)

  • cheers. I dont know much about CCJ's and such but worse comes to worse and I pay is that the end of it and nothing will happen to my credit?

    The letter states:
"If you pay in full within one month, you can ask the court to cancel the entry on the register, You will also need to give the court proof of payment"

Half of me wants to scrounge up what I can and pay to make it go away, they were saying it cost something like £250 to challenge. Is asking "ask the court to cancel the entry on the register" apart of that? Hell I cant pay this fine and that, not a chance.

Looking at other parts of the forum and had a look at the finances area, is there a thread/area like the Newbies one here I can go to?

Pay the judgment in time = no CCJ registered. (i.e. the judgment gets removed from the register, so it is as if it never existed)
Pay the judgment late = CCJ registered but marked as Satisfied. (For a lot of credit lenders they often don't care if a CCJ is Satisfied or not - simply having one is a no-no for them, OR they will only lend at much higher rates of interest).

Check whether you might be entitled to part or full relief from court fees, then it might not cost you (all of) the £108 uncontested set aside application fee or the £275 contested. Research via Google.
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

This Judgment should be set aside without any cost to the Defendant.

This is clearly a failing of the CCBC's making and has been going on since sometime last year - if not before.

The trouble is I have no idea how to get things changed.

Clearly the CCBC's processes are flawed to such an extent that many innocent consumers are being fleeced of hundreds of pounds each through no fault of their own.

For the CCBC to suggest that their system's failure to issue an automatic email receipt is in any way the Defendant's responsibility simply beggars belief.
Agreed.  This is completely unacceptable and keeps happening.

The OP needs to read the thread by the person whose username starts with lower case 'a', who forced the CCBC to put his case before a Judge a week or two ago.

Same situation.  There was also another person last month, same situation.  You have to really argue the toss to get your situation and proof of emailing before a Judge.
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
