Judgment for Claimant (In Default)

I just received a letter saying that I haven't replied to the the claim form.

i got a debt now of £323.48, I followed the list here  and got to the point with the defense letter and that government site MCOL, I filled it all in and treated it as read only like it says here

I did the MOLC and email my signed defense to the court and was waiting for my N180 like it says. heard nothing now this!

I haven't got this money and don't know what to do!

    What do you mean "treated it as read only"? The Defence?
    If you didn't file the defence (email it) that will be why you have a default judgment
  • I followed the link in that DropBox link and did everything it said.

    Then i formed my defense letter and emailed it to 
    CCBCAQ@justice.gov.uk

    with my claimant number in the subject line and such

    When was the claim issued, when did you file the AoS and when did you file your defence?

    There have been problems with emails to the CCBC. If you submitted it after 4pm (close of business) on any day, it can be missed by the staff the following day, if it was on a Friday, even greater risk.  If you've used gmail (and possibly hotmail) there seems to be a problem. 

    Contact the CCBC and ask them to get to the bottom of this. Escalate the call if you're being stonewalled. Expect a lengthy wait on the phone, so call from 9am for possible shorter wait time. 

    Alternatively, email them with the details (and proof of sending - screenshot of your 'Sent' box showing the date and time of sending), and ask them to put the issue in front of a Procedural Judge. 

    By when does the court instruct you to make payment to the Claimant?
    Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

    cheers doing so now funny enough, I emailed via Gmail, there saying if i didn't get an auto response they cant  investigate and there's a cost to do so.

    The person on line has spoken to her manager, they have taken the details of when i sent the email (got the meta data from gmail) and they are going to call back today or Friday.

    I am dropping brick here, I cant take a hit, worse comes to worse, if I somehow pay the amount in a month my credit wont get a hit? like it never happened?  I know it not the be all and end all but i got myself out of hell the last 6 years and i don't want any new mark as it clean now...

    I cant remember the full dates of everything but i did everything within the timeframes on Newbies Thread and made sure, got the max day from doing the MCOL and all that, I did a post asking for advice on the defense letter, shot it off and thought I was ahead of the curve.

    yeh odd thing the letter is dated the 23rd of March and nothing else

    Ha! sorry today or Monday, hope its today and they can help, do not want this over my head on the weekend. I am assuming if they find my email everything will restart as if it was received correctly? I hope so.

    Like you, I hope so too, but it's never straightforward.  You may need to be resilient. 

    You've probably got a number of days to pay off the cost order, so don't overlook doing that if necessary to avoid a credit-crunching CCJ, then look towards applying for a set aside. There'll be a cost to getting a judgment set aside, but that will pale into insignificance against a 6-year credit clamp!
