Vendors of purchase buying from probate

Hi,

I'm looking for some advice - I accepted an offer on my property in early October 2021 and had an offer accepted on a property a week later. About a month ago I was told my vendors were buying from probate... I won't pretend, I had no idea what that meant but was told it was nothing to worry about and it was all going well. 2 weeks ago the buyers of my property said they would pull out unless we completed by 18th March - I spoke to the vendors estate agent who said they weren't in a position to exchange and complete and needed an additional two weeks... my buyer wouldn't budge so to stop the chain falling through, I moved into temporary accommodation at the end of last week.

I was told on 18th that they were just waiting on a final enquiry and then we could exchange and complete the following week... today I've been told they now have all enquiries but it now all has to be submitted to the land registry for approval... I've asked how long this takes and what this means and nobody will give me a straight answer.

Does anybody know? I can't really stay in temporary accommodation beyond 1st April so I urgently need a back up plan but nobody will give me an indication on timescales... looking online it could be months but again - I might be looking at the wrong thing as I don't really understand the process.

Any advice would be greatly appreciated.

    No - nobody will give me a straight answer.... I've asked if it's the probate itself or something else and nobody will tell me...

    From the estate agent - my solicitor is chasing theirs but no response... we signed contracts like 6 weeks ago and 10 days ago were told everything from all sides was ready to go as soon as they got a final enquiry about a boundary wall that their lender has asked about... even yesterday I was still being told we were all good to exchange this week.

    estate agents are not legally trained and cannot provide specific answers. You need to be speaking to yoru conveyancer.
    Probate happens when someone dies. So the property is not being sold by the registered owner (now dead) but by either their Executer (of their will) or the Beneficiary of the will who is inheritting the property.
    Probate is managed by the Probate Office - not the Land Registry. If some application has been sent to the LR it sounds like ownership is being transfered from the deceased's name to the name of someone inheriting. This is no usually necessary and can, in fact, take some time to complete.
    But you really need more information.
    Sadly the time to investigate all this was before you moved out. Have you actually Exchanged/Completed on the sale of your currenet property? If not, consider moving back in even if it means losing this buyer. But first you need to understand exactly what is happening, and the EA is NOT the place to get this information.

    As posted what is ‘it’? 
    If an actual application has been submitted to us to update the register then a request to expedite it should be made by the conveyancer as it’s hold8ng up your purchase. 
    Your conveyancer can easily check if an application has been submitted so don’t have to rely on anyone else to confirm. 
    DM us the property address/title number and we can check and at least you’d then know whether ‘ir’ involves us or not
