PCN Overdue

Hello, 

I, as a keeper, received PCN overdue notice (attached) stating that PCN was affixed to your vehicle because it was parked in a manner whereby the driver became liable for a parking charge. However, the driver didn't receive any PCN by hand or affixed on the vehicle.

They have uploaded 3 photos on their website - 2 pics of the car from the back and 1 photo of the parking notice. None of the car pics show that a PCN was affixed and there isn't a parking notice sign on the side where car was parked. It's not very clear but you can see that driver is inside the car and two photos have only couple of seconds difference (I'd say driver only parked there for a few minutes max.) I've submitted a SAR already asking for all the pics taken by them.

I've gone through sticky post and can see that it's advised that to complain to the shopping centre first and then appeal. However, there are only 5 more days left left for appeal deadline. 

I've also looked at POFA - 
4)The notice must be given by—
(a)handing it to the keeper, or leaving it at a current address for service for the keeper, within the relevant period; or
(b)sending it by post to a current address for service for the keeper so that it is delivered to that address within the relevant period.
(5)The relevant period for the purposes of sub-paragraph (4) is the period of 14 days beginning with the day after that on which the specified period of parking ended.

However, I read somewhere that POFA is only advisory or not mandatory applicable (some wording like that). 

Could you help writing a complaint and an appeal? The shopping store is Tesco Extra. How do I find who to complaint too?

What else would you advise to add to make it more effective?

    Complain to whom?  There already is an appeal in the newbies.  On no account tell the PPC who was driving.  Have you complained to your MP?
    You never know how far you can go until you go too far.

    Sorry no I haven't made any complaint to anyone yet. I was thinking to complain to Manager of Tesco (as per advice seen here and other forums) and then as a second step to Appeal to ParkWatch. Please advise who should I complain to.

    At the very least Tesco and your MP,  perhaps Trading Standards and your local paper.  
    You never know how far you can go until you go too far.

    @D_P_Dance - Thanks - Is there any template here for complaint text? My English is not that great to make it read as assertive enough. Also, is there anything I can do as my deadline is in the coming week (by 28th Mar 22) 

    I am also reading comments in the post mentioned by @Castle

    I was at the same site so clearly I am not the one who have to go through this. I was pretty sure there must have been other people. I wonder how many and how many already paid too.

    As per notice, I've got 28 days to pay the fine before they take matters to the next steps - this deadline is in the next few days. 

    As stated previously in this thread, the letter/notice I received just states if you wish to appeal to refer to the original Notice which “includes full details of how you can submit your appeal and the applicable timeframes”. There wasn't any first PCN/ticket, and I've already submitted SAR asking for all the photos. I've sent email to Sara too as advised in the other thread.

    Do I make an assumption and appeal with in 28 days of receiving this notice?

    Nope, do exactly the same complaint as the other poster, to Sara Roberts.  Tell her you are both posting on MSE and in both cases there was no windscreen PCN so clearly this is a pattern and this AOS member is routinely preventing people from knowing how to appeal.

    Sara will know you are on MSE anyway due to the fact you are emailing her direct.  BPA have some respect for MSE forum regulars.  They have to!

    I emailed Sara with similar wording you had posted in the other post and Sara has replied and given me a case reference number now. You guys deserve respect for this community service definitely and great that BPA is appreciating it too. 

    I guess I'll receive another notification after 28 days from Park Watch. I just didn't want it to create any bad reference on my credit history so been trying to find out what to do to avoid that situation.
