    Explain why my stepdaughter's Notice was quashed without seeing the light of a courtroom. Explain the court judgement of March 10. How would a PPC have authority on a public road? VCS have NO authority outside of a car park, and in the absence of a contract, they would appear to have none inside a car park either.
    I'm not trying to 'explain' anything, I'm merely pointing to the fact that, as you indicated, there are some LJLA Ts & Cs covering their car parks. I recognise that Ts & Cs are not a contract with VCS, and they need to have a contemporaneous one to allow them to meet ATA AOS and DVLA Kadoe obligations. You assert they have no current contract - I'm not arguing they have. Until proved otherwise, I take what you're saying at face value. 

    I've no idea why your niece's case was quashed. Almost no VCS LJLA stopping case has ever seen the light of any court room. That's a position that has been maintained for years. In most years, advice here and on PePiPoo, once the initial faff has died down, has been to forget about the case ever going any further. Covid revenue starvation seems to have stirred VCS into pressing the court threat a bit harder, but still no court case that I've read in detail as yet. 

    Was it your court hearing on 10 March?  If not, is it one that we've been covering previously?

    I asked the question whether there were any similar LJLA roadway Ts & Cs that similarly mentioned (or failed to mention) VCS - none that I could find in a superficial search, but someone might have found something previously?  Having such information to hand is much more reliable than mere assertion. 

    It's not strictly true that PPCs don't have authority on public roads, a number operate on behalf of councils, particularly in the southeast. Admittedly not operating in strict private parking mode.

    Unless VCS had provided such information to their rent-a-legal who attended the hearing, then the rent-a-legal wouldn't be able to do so. That doesn't mean it doesn't exist, just that it wasn't available for that hearing.

    FWIW I personally think you have a valid angle, but it's not and can't be the only point of defence.

    So much information to take in the last few days I now understand things a lot better so thanks for your comments. The language used has always been “stopping” and not parking/waiting. As you say, even if the contract has been renewed and they are in possession of a copy, the fact they have not included it in the bundle for court means I can’t possibly defend against it. I will get my hands on the Ljla parking principles asap. 

    @uptonbubbles just updated his/her thread to say VCS discontinued.

    What happened in your case in the end, please?

  • Just for information, having been through the same hoops as others who have been issued such PCNs at Liverpool Airport, my case was referred to my local court on the small claims track; the magistrate, however, decided that he/she wanted to have a preliminary hearing by conference call and I was sent the terms for having to do so. Both parties were required to submit their evidence by 23/12 and both parties were advised that the magistrate could well take the view of deciding the case at the preliminary hearing. There were some particular nuances to my case (as in most cases) including the failure of VCS and/or ELMS to answer the specific questions I asked. I was fully prepped to attend the call but VCS (M Wali) issued a discontinuance on 20th.

    We anticipate it will be open very soon.

    We all need to ram the nail in the coffin of the false £70 'DRA fee' add-on, that actually funds the court claim and toxic CCJ culture, as well as the DRA gaslighting of people.

    If PPCs manage to turn around the decision on banning the gaslighting / claim-funding 'fees' then the DLUHC will be rubber-stamping £200 parking charges and if that happens, they (Government) and the PPCs will wreck high streets and people's lives.  Whoever is responsible, if that happens (and it very nearly did in 2021) must hang their heads in shame.
