Good afternoon
I have received a Letter Before Claim (LBC) from ELMS Legal (I note that there seem to be some revived activity as there are number of these letters now being received, no doubt bought about by slim pickings during the pandemic!). for an alleged 'stopping' offence in May 2018 on one of the roads around the airport parking areas because we couldn't locate the relevant car park. In truth, it is my wife who is receiving the letters and I am representing her interests in this matter, Up until this LBC, we have completely ignored all of the other nonsense and threats and we have admitted nothing, including the identity of the driver. The car was simply stopped for a few seconds so that I could read the signage, since it isn't possible to read them whilst moving! The date on the letter from ELMS Legal is 24 Sept 2021, it was received on 1 October and the 'settlement date' is 23 Sept 2021! Appreciate that I (we) have to respond to this letter, but I am not clear to whom or to which entity I should respond and in what form. I've read many of the similar cases on the forum and there are a couple which seem to be the correct type of response. Please let me know if you want me to post any of the correspondence which will of course be redacted. Your advice would be much appreciated. Many thanks.

If by the 'correct type of response' you are talking about the really old one that tells them they've failed to meet the 'new PAP' for debt claims, forget it.
Just respond as per the NEWBIES THREAD (your wife must respond, not you, but you can write it/do it/set up a new email account in her name with her agreement and handle it all 'as her/for her' but not in your name).
Also tell them the reasons why she disputes the claim and if she wasn't driving, then say so right now (without naming the driver) because that means she isn't liable on this non-relevant land. No keeper liability exists on byelaws land because the POFA doesn't apply.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Have you complained to your MP? Have you read about keeper liabiliy under POFA on land covered bt bye-laws? Have you read the Code of Practice wrt grace periods?You never know how far you can go until you go too far.0
