Highview parking County Court Claim SAR and Defense advice - reduced timeframe due to postal error!

  • Thank you for replying @Le_Kirk! I have reviewed it and I'm still waiting to hear anything from the court or claimant (Highview) following that letter.

    The letter from the CCJ team stated a confirmation of them receiving my defence (confirmed by the CCBAQ email confirmation too) as well as saying the claimant has 28 days to reply with their defence and whether or not they want to proceed - that deadline is close to or has passed so I am awaiting that. Is this normal? It doesn't seem to be on the newbie's thread.

    As it has nearly been a month since I submitted my defence, I have not received a DQ N180 form, should I send one to the court anyway?

    Whilst you know the CCBC has received your defence, you don't know when they sent it to the claimant, so you don't know when the 28 days started, let alone when it finishes.

    It's pretty much as @Fruitcake has written above.  Just to be aware it is not the CCJ team it is the CCBC. 
    CCJ stands for County Court Judgment and we are trying to prevent you getting one of those!
    CCBC stands for County Court Business Centre and they deal with the "back office" stuff for small claims.
    Just keep checking your MCOL status page and you will see when thing start to move on.

    Yes, your claim history will/should update as MCOL sends defence to claimant and receives claimant's confirmation they wish to proceed and will then send DQ's to claimant and then to you.

    When it is time to do your N180, make sure it has come from the court, or is one you downloaded yourself. PPCs sometimes send one partly filled out with information to their advantage and to the defendant's disadvantage, sneaky barstewards that they are.

    Thank you all so much for helping me in the past and apologies for dredging up this post but I have now received a court date and request to submit my Witness Statement by a date in mid-November. I was wondering from your experiences what the chances are of this being dropped closer to the date? Current court date is in March
