  • Update - hearing date is the end of March. WS needs to be in by Jan 30th. 

    Got a lovely email today, as you all knew I would!  'I can confirm our Client would be agreeable to £230.00 in full and final settlement of this Claim.'

    Going to crack on with it all next week, I apologise in advance for any stupid questions I may ask going forwards.

    I'd reply that you'd rather stick needles in your eyes and can DCBLegal please crack on with the inevitable notice of discontinuance and stop wasting everyone's time.

    Okay, here is the first go at my WS. (I still need to add in all the images/exhibits and finish the index when everything is in place) 
    Be kind please, my head is a shed and I am trying very hard to not only get this right but understand everything!

    I am not very confident it is correct. I started writing it months ago (before the strike out) and was using whatever WS everyone was being directed to at the time. Then when I came back to continue it I was using another WS as an example, then I accidentally deleted a lot of it then started using the aphex WS then got the deleted parts back (sigh!)....now its a mash of a few WS examples and the more of them I read to try and learn from and the more I edit mine, the worse it gets!

    So before I screw it up more....please tell me what I have done wrong, what I have missed or what I have included that I don't need.

    Para 14: typo 'not eligible' should be 'not legible'.

    Para 16: the first paragraph is in italics and shouldn't be because it's not a quote. 

    Remove the first sentence of para 22 because the false added 'fee' is not (yet) banned by the Government.

    I cannot express how much I appreciate the help you and everyone else has given me so far. I will get onto those fixes ASAP, add everything in and post up the (hopefully) finished product soon.

    It has to be in on the 30th which is a Monday, should I wait until the last day or would it be safer to send it all over on the Friday? Have had nothing from DCB since their offer email so no clue what their plan is yet!

    High praise indeed, you should really pat yourself on the back for doing such a good job with your research and understanding.

    IMHO I'd send it over Friday and make sure you get an acknowledgement email.

    @Umkomaas, I think the OP is heading towards filing a Witness Statement and evidence.
    In which case it should be sent to the hearing court and in turn that means the MCOL plays no further part and will not be updated.

    And OP, don't forget to send a copy of that stuff to the Claimant.
