    Send the email but this time email ccbc@justice.gov.uk and tell them what the issue was with proof of them being email.  Tell them  this

    It has come to my attention a default judgement has been made against yet i emailed the defence on xx date, i attach proof via a pdf version/jpg pic of the email sent
    I also attach the original defence sent
    Please therefore put this in front of a procedural judge and confirm this has been done.  This is an error on the part of the CCBC and I would ask the judge to expunge the default judgement and bring the claim back to where it should be (with an allocation form being issued)
    Please confirm receipt of this and that is has now been forward to a judge for consideration

    Thanks. Just sent the email with the attachments to ccbc@justice.gov.uk. This time we received the auto-response. Will keep you posted. Fingers crossed.

    Update: just received this response from CCBC:

    "Good morning,

    Thank you for your email.
    If we received your emails submitting your defense you will have been sent an automated bounce back email. That will confirm the date that we received your email with the defense. Please forward this to us so we can look into your case.
    I hope this is of assistance. If you require further information please contact us.
    Kind Regards,"

    Of course I did not receive any confirmation back in the days despite sending two emails on different days. Also got another email from the CCBCAQ email account saying that in case I want to challenge the default judgment I need to file an application and pay £275.00.

    Any tip on what to do/say? Shall I formally complain?

    Go back to them and say this was not received bit you have sent evidence of the defence being emailed and as per your email you require this case to be out in front of a judge forthwith.

    Copy all the correspondence to  the courts to  your MP and make a formal complaint to him/her..
    You never know how far you can go until you go too far.

    This is now becoming ridiculous. Submitted again the emails sent to CCBC back in the days and reattached the defense. Here is the response after a few days:

    "Dear XXXXX,

    Thank you for your email.
    I am unable to locate your defense in our email inbox.
    The only one that was received at CCBC is dated 7/03/22, which is out of time.
    The screenshots you have attached are unreadable (blurry and too small to read), therefore I can't accept them. Please provide this evidence in better quality.
    You should also check your junk inbox, for bounce back from the court.
    Kind regards"

    Nothing has ever come from CCBC. On two different dates no automatic message, signaling an error in their system. That other discussion ( forums.moneysavingexpert.com/discussion/comment/79041379/#Comment_79041379about the use of capital vs. non-capital letters in the email is also embarrassing.

    My plan is to resend the evidence in a different picture format and say that if it doesn't go through I would formally complain to my MP and to HM Justice (also tempted to go to the media if things go nasty). Any further suggestion is more than welcome.


    In a period where we spend more and more money and taxes are going up it is disgraceful to have this type of treatment..

    This is what cuts to the justice system look like.  

    Everyone should routinely email pleadings to the claimant in my view.  There is no down side to doing so and the claimant would not then have applied.

    Are you copying and pasting the reply from the CCBC, or are you re typing it?
    Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

    Use the name of the person the other poster told us about, for complaints.  Ring up and demand to speak to him.  You posted on that person's thread I think and he gave us a name.

    Don't use a screenshot.  Actually re-forward your 'sent item' in full.  Not the sent item from March.

    Update: sent an email with a formal complaint to CCBC last Friday (18th March) attaching the original defence and the email exchanges with CCBC.

     A letter just came through the post (dated on the 18th).

    "Dear XXXX,

    Re: Case number XXXXXX Uk Parking Control Limited vs. XXXX

    I am writing in regard to the above claim.

    Please be advised that your case has been referred to a District Judge for directions on how to proceed.

    It can take 2-4 weeks to receive a response at which point you will be notified accordingly. 

    If you require any further information, please email us or contact our helpdesk on the number above.

    Please accept our apologies for any inconvenience caused.

    Yours faithfully, "

    Does it mean now the judge will look into the case/defense?
