Advice please MIL has....

recently bought a new car.. no probs we advised her to call a scrapper to collect her old car... she has just phoned to say a local motor mechanic (think very back street)will buy from her and she has just given him the log book...

eeek says I you need to fill it in and send off... I speak to "dealer" and it would appear is is gonna sell it on but doesnt want to fill in his details on the log book.. I ask how long before he sells it... poss 6 months he says..

Am I right in thinking MIL is liable as she is still the owner (according to DVLA anyway).. he is gonna put this car on the street but says okay as he has insurance,, but Im concerned as she has cancelled her insurance BUT she is still technically the legal owner and as such the vehicle shouldnt be kept on a rd.....

Sorry for the waffle just worried in case she gets landed with speeding fines, tax fines and no insurance because of her good nature..

Where does she stand legally... Help!!!:confused::confused:

  • im sure there is a part on the log book you can send away to the dvla if the car is owned by a dealer,so that this doesnt add another owner on the car but frees the last owner of responsibility of the car. i think.
    im sure a harveybobbles will be along to tell you exactly what its called.

    Section V5C/3 - Notification of sale/transfer to the motor trade/insurer/dismantler.

    You fill out this section, it's on page 2 of the v5 at the top (yellow), sign it etc then you (seller) posts this section only to the DVLA. The main part of the v5, page 1, gets passed onto the dealer

    I once handed over my log book to a dealer who promised to fill in my bit and send it to the DVLA instead the dealer did nothing. The dealer (a huge Toyota dealer) then sold my old car that he had taken in part exchange again not doing anything with the log book. I then started to get telephone calls from the police because my old vehicle had been involved in several incidences of dangerous driving, I was threatened with prosecution if I failed to tell them who the driver was, it took ages to sort out because a) I didn't have a clue who was driving it and b) it had been taken in part exchange 6 months previously.

    Don't ever rely on the garage to do the right thing, I would be asking for my bit of the document back and be completing it myself to notify the DVLA that I no longer owned the vehicle.
  • This "dealer" wont fill his details in... (sign to say hes is in possession) I spoke to him on phone.....he now has car, keys and log book....

    If you do not have a V5/V5C you can still inform DVLA that you no longer have the vehicle. In order to do this you must write to DVLA, Swansea, SA99 1AR quoting the vehicle registration mark, make and model, exact date of sale and name and address of the new keeper. However, you should note that DVLA records will not be complete until the new keeper tells DVLA in writing. Until they do, the police may need to contact you if they have to make enquiries about the vehicle.)

    How to notify DVLA if you sell your vehicle

    email them straight away and print a copy to keep for your records,also send the name and address of the 'dealer',date,and apx time that you sold the car to Swansea and again keep a copy,

  • Yep follow as hartcjhart says except you cannot email DVLA to notify of a disposal, it must be done in writing to:

    DVLA Swansea SA99 1AR.

    Your MIL will get a letter back within 4 weeks confirm DVLA have received the details, then she is no longer liable. If she has not received letter after 4 weeks then she needs to ring them on 0870 240 0010 to ensure her letter has been received so that she is not liable for the vehicle.

    If she wants peace of mind she can send it by recorded delivery to ensure it is received.

    In a slight disagreement

    you can email them,BUT it must be sent in writing to actually facilitate the change,

    why I said email is that DVLA will have notification on their email system straight away,they are notorious for losing paper documents,and if they do you will have alternative proof to show to the authoroties if needed

    She will still be liable for any fines for speeding etc if the garage decides to drive the car about. I would try to get the log book changed as quick as possible.
  • You won't acheive anything by emailing DVLA as you will just get an automated response saying to write in as by law it cannot be accepted by email and it will not count as evidence of you informing DVLA

    - I'm not being picky but I work in the emails dept at DVLA so I just don't want you/your MIL to waste your time!

    So Flutterby, you work in DVLA,And you cant email,so why then HAVE I BEEN ABLE to contact them Via email about vehicles,and reg docs, and get A HUMAN RESPONSE

    DO YOU ACCEPT THAT YOU MESS UP? AND LOSE DOCS, I CAN PROVIDE LOADS OF EVIDENCE ON THIS

    just going to search old emails to see if I have the evidence STILL LISTED
