YOU MUST READ THE NEWBIES THREAD
No bailiffs will call, it's just the stupid imagination of money scammers
DCBL are scamming you, you do not owe £155.
Read the newbies thred, understand it and then come back and help will be given to see off DCBL
DO NOT CONSIDER PAYING
3 -
No paying.
Yes, there will be a court case but no-one pays these. The Government has just banned the added 'debt recovery' fee, with the DLUHC declaring it to be 'designed to extort money from motorists'.
Complain to the retail park agents now and read the NEWBIES thread second post about pre-court stage.
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Today I received an email from DCB legal with the evidence attached and asking me to pay £155
As well as reading the newbies, please read this, and complain to your MP?They have added what appears to be an extra unlawful amount for debt collection.
This amounts to double recovery and Judges all over the country are dismissing these spurious additions. Indeed some judges have dismissed entire claims because of this. Read this and complain to Trading Standards and your MP,
Excel v Wilkinson
At the Bradford County Court, District Judge Claire Jackson (now HHJ Jackson, a Specialist Civil Circuit Judge) decided to hear a 'test case' a few months ago, where £60 had been added to a parking charge despite Judges up and down the country repeatedly disallowing that sum and warning parking firms not to waste court time with such spurious claims. That case was Excel v Wilkinson: G4QZ465V, heard in July 2020 and leave to appeal was refused and that route was not pursued. The Judge concluded that such claims are proceedings with 'an improper collateral purpose'. This Judge - and others who have since copied her words and struck dozens of cases out in late 2020 and into 2021 - went into significant detail and concluded that parking operators (such as this Claimant) are seeking to circumvent CPR 27.14 as well as breaching the Consumer Rights Act 2015. DJ Hickinbottom has recently struck more cases out in that court area, stating: ''I find that striking out this claim is the only appropriate manner in which the disapproval of the court can be shown''.

However, VCS appealed this so it may not apply in all cases, read this

Also this,
"Abuse of process – the quantum
13. In addition to the disputed Parking Charge Notice claim amount of £100, the Claimant has added a sum of £60 that is disingenuously described variously as 'debt collection costs', ‘additional charges levied to cover the cost of recovery’, ‘additional administration costs’, ‘debt recovery costs’, ‘initial legal costs’ and ‘recovery costs’. The added £60 constitutes double recovery and the court is invited to find the quantum claimed is false and an abuse of process as was found by District Judge Claire Jackson (now HHJ Jackson, a Specialist Civil Circuit Judge) in Excel vs Wilkinson: G4QZ465V, a similar case in which £60 had been added to a parking charge, heard in July 2020 (the transcript of which is exhibit XX-04). The Judge concluded that such claims are proceedings with 'an improper collateral purpose'. Leave to appeal was refused and that route was not pursued."
Also consider complaining to The SRA about the solicitor, if one is involved They are fully aware of the unlawful nature of most of thse additions yet persist in adding them..

Thank you, I have read the newbies thread and I am overwhelmed if I have to defend this and write a witness statement like the example posted and provide photos etc. I have no defence as I did overstay and they have pictures of me. I know they are scammers but at this stage, after 5 years, I think I would rather pay the £155 and get on with my life. Sorry to sound defeatist.I just want to know if I should ignore DCB legal LTD email the one they attach all evidence and their Bacs details on the main email or should I wait for an official letter? or see if they will take me to court and pay then before I go to court? Although I don’t wish to defend, I want to make it as hard as possible for them to get this £155.I really value your advice thank you .0

A lot of the wortk has been done for you in the newbies, have you not read them\?You never know how far you can go until you go too far.0 -
Before you make a decision, give us a little more info, such as a) how long do they say that you overstayed, b) is it an ANPR controlled car park c) which parking company is it ?The pen is mightier than the sword ..... and I have many pens.2

You have not had a letter from a bailiff and as this has not been to court there is no debt only an alleged one,Coupon Mad has already told you above that you do not owe the debt collection fee so why would you pay them £155?What evidence did they supply, and how long was the overstay? You ask for help and give no details of what the scammers have alleged.2

Apologies. So the evidence DCB Legal limited have provided is:
1.pictures of signage
2. Witness statement on behalf of water fields retail park Watford as the landowner.
3. Picture of me arriving at 11.04 on 28/10/2016
4. picture of me leaving 14.40.I believe I overstayed by an hour or so.
As per newbies thread I did email waterfields retail park but got no reply. I haven’t contacted my MP. When the letter before claim arrived I followed the instructions on the thread and asked for all the data they hold on me so now they have my email and sent me an email asking me to pay £155 within 30 days or risk further action.0 -

Send them a response about the fact adding fake costs to a parking charge is banned by the Government. See my version I wrote on 24th February that starts 'Dear R Taylor' and change 'CIS' to 'DCBLegal':

Thank you amazing responses. Will fight these scammers and report back.
Just quickly I read on the thread somewhere that DCB legal is different to DCB legal ltd and the latter should not be ignored which I haven’t I replied within 30 days to their letter before claim. I did receive lots of letters previously from the former which I did ignore is this correct?1
