is the sale dependent on the seller buying another property



Confused as I'm told I'm in a chain? I thought this meant your not. Am I wrong?

    So are you the buyer and the seller filled in the form that you're showing?

    If so, it's possible that the seller has changed their mind since filling in that form. Ask the estate agent what the seller's current plans are.



    Or are you the seller and you filled in that form? If so, there might be a chain below your buyer.

    Or they might simply have a preference to buy simultaneously, but if need be they'll find somewhere else to stay rather than jeopardise the sale to you.

  • I'm the buyer. Basically i just need to keep waiting it out as that form isn't really set in stone. I offered on hers in October and the cash from my sales have been waiting with my solicitor since last year. Unfortunately she only found a house at the end of january and in the meantime I'm now off the deeds of my current property now owned by my ex so is causing friction. So just eager to move quick.

    we are in the same situation. We have been told the preference of our seller is to find another property and complete at the same time however, they will go into rented rather than lose the sale 🤷🏼‍♂️

    It would be ridiculous for it to somehow take effect before you've exchanged contracts - by which time the seller's position will have become obvious.

    Is there the possibility that the seller is happy to complete on their sale, independently to their purchase?

    Do you have a chain below you?

    Look on the last page of the Property Information Form, where the seller has signed and dated the document.  This should tell you that the information provided within that form was correct at that date.  But until you have exchanged, it is not legally binding and therefore things can and do change, as it seems to have done here.
  • Theres no chain either way. Hers is empty shes buying and i've already sold mine and have the cash. Its was signed in November. But like you say if its changeable then the contracts are not really worth the paper they are written on I suppose. Im about 4 weeks in now to her having had her offer accepted. Im hoping it all goes quickly now!

    The form means the seller is saying "at the moment, my plan is that I don't to sell/buy on the same day".

    If the form (or that question on the form) didn't exist, the buyer wouldn't have that information.


    It's like when a seller accepts an offer, the seller is essentially saying "at the moment, my plan is to sell you my property".


    But some sellers change their minds or they might even 'fib' - so you need to bear that in mind when reading the form, or when you get an offer accepted etc.
