Cheers thewad, I intend to contact Stepchange once all my debts have defaulted. I don't really care about my credit rating as i don't live in the UK any more and don't intend to return.
Your debts will become statute barred after six years of non-payment/acknowledgement

Court action on someone with an unknown foreign address is unlikely

I think Sourcrates was saying that even in the unlikely event of a court claim resulting in a ccj, they are expected to enforce the ccj itself within six years. No-one's going to be throwing good money after bad so this is unlikely.

As said before, you can't use stepchange in your position

    OK many thanks.
Would it be likley for debt collectors etc to go round to the address where my bank mail goes to?
Also if I wanted to do a self managed DMP, is there a starting point or place of advice for this?

I can't post a link but if you search for debtcamel that site has advice on setting up a self managed debt management plan.

    You've got 35k of debt.

How much per month are you intending to pay to the dmp?
  • I am considering taking @sourcrates suggestion of simply not paying it back. If it is a viable option as you suggest, then it makes more sense than a DMP.

I intend to set up a PO Box so that all my mail goes there, which takes away the worry that my parents are currently getting lods of bank mail for me. However, their house will still be the registered address.

Anyone know how likely it is that at some point, debt collectors or bailiifs would physically go round there in person?

As a rule of thumb about one debt in ten sees court action.

On a consumer credit act debt any bailiff action must use the county court bailiff, and they don't cause a problem.

It's more likely that if any of them did get a ccj, they would be doing so because they've bought the debt and it's getting near the 6-year mark since you last paid.

It's really difficult to enforce a debt when someone lives abroad and without a proper address it's a non-starter.

How would they know I live abroad though? I intend to just ignore all the letters until the debt goes to default... then ignore any follow-up letters... I am not going to tell them I live abroad... or should I tell them but obviously not tell them where...

Surely at some point somebody will go round to my parents house, no?
  • Hi guys, thank you for all of your help and advice so far. I think I intend to change my bank address details to my friends house and then simply let everything run to default and then, eventually, to statute barred.

So lets say I just let all my debts run to default, and never respond to a single letter ever again, what are the consequences? Apart from trashing my credit file of course, but as I said, I live overseas and have no intention of moving back to the UK, so i am not bothered.

I have a few questions, if anyone can help:

    1) If no CCJs are issued, my debts will become statute barred after 6 years, and unenforceable, is that correct?
    2) Let's say a CCJ IS issued. Do i get taken to court? Or do I just ignore that too? What are the consequences of ignoring a CCJ?
    3) Is there any possibility of people physically going to my address to chase up the debts, or no?
    4) Many of you have said 'they won't chase up debt from someone living abroad' but how will they know I live abroad? Should I tell them? (Obviously not tell them where specifically I am... but should I tell them I live overseas?)
    5) Will my credit file ever recover? I mean many many years later... will these debts slide off the record and I can start 'from scratch' so to speak?

My UK driving license for example is registered to my parents address. So even if i change my bank address, I guess they could still recognise that I am 'registered' at my parents address, because of my UK driving licence being there. Any thoughts?

Thanks in advance, your advice is much appreciated.

    (1) That is correct yes.
    (2) All a court does is pronounce judgement, its the creditor who decides how far the legal process goes, if they can`t find you, they can`t do anything can they.
    (3) Vague possibility if a CCJ goes to bailiff action.
    (4) All they will know is you are not responding to there attempts to contact you, doesn't matter where you live, they won`t be able to trace you if you are not resident in the UK.
    (5) Yes, after 6 years all negative information is deleted.
