Vehicle Images contained in PCN: BPA CoP version 8 - non-complianceThe BPA Code of Practice point 21.5a stipulates that:"When issuing a parking charge notice you may use photographs as evidence that a vehicle was parked in an unauthorised way. The photographs must refer to and confirm the incident which you claim was unauthorised. A date and time stamp should be included on the photograph. All photographs used for evidence should be clear and legible and must not be retouched or digitally altered."UKPC's PCN contains two date and time stamped photographs. The first of these is almost entirely black save for a couple of white patches. Between the white patches is a grey area that may or may not be a number plate? If it is a number plate, it fails any reasonable test of legibility. The second photograph is entirely black with no distinguishing features at all save for the date and time stamp. In no way could this photograph be described as 'clear and legible'. Neither of these images clearly identify the vehicle parked, entering or leaving this car park. It is impossible to verify the location that the photographs were taken.Beneath these two photographs purporting to be evidence are enlarged pictures of two number plates. These fail any objective test of evidence since they do not contain a date and time stamp “on the photograph” and have been enhanced, digitally altered or come from entirely different photographs to the ones presented as evidence.I require UKPC to produce evidence of the original "un-cropped" images containing the required date and time stamp and to evidence where the photographs show the vehicle to be when there is a lack of any marker or sign to indisputably relate these photos to the location stated.1

            I submitted my POPLA appeal a couple of weeks ago but instead of UKPC presenting their evidence, I have received a letter from a debt recovery company.
What does this mean? If UKPC don't defend the POPLA appeal, that is the end of it surely? Will I not get a judgement in default from POPLA?
UKPC still have a little time to present their evidence. Should I wait or take some pro-active action?0 -

I can log in to the appeal tracker and it tells me "We have received your appeal and have requested the parking operator to provide information and evidence about your appeal. Once the operator sends us their evidence it will appear here. We will notify you when we receive this information and evidence so that you can provide your comments."0
