Hi

Me and my grandmum have received a letter from county court over unpaid parking tickets issued by Gladstone. I have few issues so really need please!

1. My grandma isn’t in this country, she isn’t back til May. So what should I do? Can I ask for a postponement or can I fight on her behalf as she has given me consent.

2. Re my ticket, it’s from last year June and I seriously Can’t remember what occurred. Most likely I overstayed but that would be a guess. What should I do? Iv read that I can ask Gladstone to give me details of the contravention, but then again I only have 5 weeks till I have to sumbit my defence so will that be enough time? 

Any help on the two scenarios will greatly be appreciated.

    If you have received a claim form you can help your gran submit a defence to the county court and if you have only just got the claim form there will be no hearing until the summer in any case.  In addition the hearing is most likely to be video or phone

    Have you read the 'Newbies' as everyone is advised to do, for help and advise on all the steps??

    It’s the county court business centre. Isn’t that same as county court?  I’m confused now?
  • What about my claim, is it worth asking for pictures and reason why I got a parking ticket? Or is it too late as I have 5 weeks to submit my defence? 
    Issue is I don’t know what to base it on as I don’t know why I’m being taken to court?

    What is the Issue Date on the County Court Claim Form?

    The named Defendant is the person who must defend the Claim.

    Of course you can do all the work at this stage, but it must be done in the name of the named Defendant.

    Any help on the two scenarios will greatly be appreciated.
    The two cases must be dealt with separately and on two separate threads. Keep your case on this one, and open a new one for your gran's case. 

    Just by way of more background, are both cases relating to the one parking firm, the same parking location, the same parking infringement and are the same solicitors dealing with both claims?

    Hi thanks for your reply. Yes they’re both same parking infringements on same car park. And it occurred on the same day. We both live at same address. We both can’t remember this happening. That’s why I kept both on same page as il defend both of us. 
    It’s Gladstone representing parallel parking. 

    Should I send a SAR? Or will I not get the info before my defence deadline?

    With a Claim Issue Date of 9th February, you have until Monday 28th February to file an Acknowledgment of Service but there is nothing to be gained by delaying it. 
    To file an AoS, follow the guidance in the Dropbox file linked from the second post in the NEWBIES thread.

    Having filed an AoS in a timely manner, you have until 4pm on Monday 14th March 2022 to file your Defence.
    That's four weeks away. Plenty of time to produce a Defence, but please don't leave it to the last minute.
    To create a Defence, and then file a Defence by email, look again at the second post on the NEWBIES thread - immediately following where you found the Acknowledgment of Service instructions.
    Don't miss the deadline for filing an Acknowledgment of Service, nor that for filing a Defence.

    Do not try and file a Defence via the MoneyClaimOnline website. Once an Acknowledgment of Service has been filed, the MCOL website should be treated as 'read only'.

    Of course everywhere I have written 'you' or 'your' I mean the named Defendant.

    Thank you for your info. Unfortunately the newbie post states to send the SAR initially. So i dont know if it still applies as I am more further in. So Im not sure what I should base my defence on. Any help guys please???
