Probate flat

Hello, we have had a offer accepted at the end of January on a probate flat however, unable to apply for the mortgage because we are yet to receive the service / ground rent info. The estate agent have said the sellers are chasing our mortgage offer. Is this normal? 

Our conveyancer has confirmed he has requested this but yet to receive. Is there anyone i can contact to chase this or try and get it myself?

i can see the charges have been listed on another flat a few doors down. Will this be the same for our property?

    I doubt your lender needs exact figures for the purposes of getting the offer processed - have the executors no idea what the charges are? 

    Is the other flat part of the same development?
  • Give the best estimates you can, explaining where you got data from and stressing it's an estimate

    I'm surprised you cn't apply while waiting for this information.
    I'd be more concered about it being a probate sale. Has probate been granted?

    I think a swap is required, through the EA.  "You supply me with the service charges bills and I'll supply my mortgage offer".

    I was fortunate that my late Mum's managing agent sent everything to me after showing a DC.  Consequently, the Executors in this instance should be able to provide proof of invoices or push the MA along.  Fingers crossed for you.

    In your position, I would do the following...

    • Tell the estate agent that you need copies of the recent ground rent demands, and the service charge demands (or service charge accounts).
    • Ask the estate agent if the executors have copies of these. 
    • If they do have copies, ask that they forward copies to you, and also that copies are forwarded to the executor's solicitor to be passed to your solicitors.
    • If the executors don't have copies, ask that they request copies from the freeholder (or that the executor's solicitor request copies from the freeholders). And ask the executors to chase the freeholders until they are provided.
    • Ask that they forward copies to you, and copies are forwarded to the executor's solicitor to be passed to your solicitors.

    You can use the info on the copies sent to you in order to make the mortgage application. But later on, double check that the info in your copies is the same as the info on the copies that your solicitor receives.

    Yes, it has been granted.

    Yes same development. All ground floor purpose built maisonettes. We’d be number 10 also listed is number 18. When we done a brief check with Natwest they done a £150pm estimate however, based on number 18’s listing it would be £37pm and £10 per year ground rent

    Thank you. We asked the EA as soon as offer was accepted and they said as the owner was deceased they didn’t have any of the info. I called the probate company (Move with Us) and was advised that my conveyancer had to request it from the vendors solicitor.

    The freeholder will be the local council. Assume they won’t give it directly to me wiukd they?

    If the executors / probate company are being unhelpful, it's going to slow things down.

    If they'd been on the ball, they should have requested details of service charges etc from the freeholder before putting the flat on the market.

    As you say, the freeholder won't give you the information.
