Right to buy sec 125 notice

Hi. I received my section 125 notice about more then 2 months ago however i had to go abroad because of illness of two close family members. Sadly both of them passed away. When i come back, the deadline wchich is 3 months from date of letter is close. I am in process of getting mortgage and have principal agreement however it will take about four weeks to be offered as advised by lender.  Should i ask council to extend or wait for their further notice. Any suggestions

    Sorry for your loss.

I'd talk to the council and hope there is someone with some understanding there.  I'm afraid you can only be advised generally here.  The best people to talk to are the people on the ground local to you.

I googled 'can a S125 notice be extended' and came up with this

    Tenant's acceptance
Within 12 weeks of receiving the section 125 notice, or of receiving the district valuer's valuation, the tenant must write to the landlord to let them know whether they wish to go ahead with the right to buy[12] or to withdraw the application.
A reminder can be sent if the tenant does not contact the landlord following the section 125 notice.[13]
The tenant has 28 days to respond, or longer if the landlord allows or if it is unreasonable to expect the tenant to respond in 28 days (for example if they are in hospital, for instance).
The application fails if the tenant does not respond to the reminder letter in the time allowed.

  • When I was doing RTB admin, I'd always tell the applicant that I must send the default notice as part of the process and then I am in a position to offer extensions.
