There is only one blue text template appeal in the NEWBIES thread. You can't miss it.Fruitcake said:Use the appeal template in blue text from the NEWBIES sticky Announcement. It should be sent unaltered, from The Keeper.1 -
You are missing the point here, if you had to go back and search out those signs because they were hidden or not obvious that is unfair and does not conform to their ATA's COP:Signs should, where practicable, be placed at the entrance to a site. Otherwise the signage
within the site must be such as to be obvious to the motorist.

I dispute your 'parking charge', as the keeper of the vehicle. I deny any liability or contractual agreement and I will be making a complaint about your predatory conduct to your client landowner.
There will be no admissions as to who was driving and no assumptions can be drawn. Since your PCN is a vague template, I require an explanation of the allegation and your evidence. You must include a close up actual photograph of the sign you contend was at the location on the material date as well as your images of the vehicle.
If the allegation concerns a PDT machine, the data supplied in response to this appeal must include the record of payments made - showing partial VRNs - and an explanation of the reason for the PCN, because your Notice does not explain it.
If the allegation involves an alleged overstay of minutes, your evidence must include the actual grace period agreed by the landowner.

Send it as it is, no edits/additions. Nothing you add/change will have any positive effect on the outcome, your appeal will be rejected, but you at least have proof that you've engaged in the PPCs process to try to resolve the issue, in the event of this going to a court hearing. Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

As said before, you need to get back to the petrol station/forecourt and tell them they are jointly and severally liable for the actions of their agents. If you are struggling on what to say, or how to say it come up with a script/letter and post it here then some of the regulars will be able to prod it in the right direction. On the face of it it appears you have been lied to by the petrol station as an attempt to deceive youFrom the Plain Language Commission:

My apologies if you are colour blind, but there is only one appeal template in the NEWBIES, and it is in blue text.
We can't keep flitting between what you have posted and the NEWBIES to check if it is the correct one, or if you have amended it at all.
