Hi,

I am following the newbies post #2 as I have now been sent a Letter of Claim by dcblegal representing Total Car Parks Ltd.

I have sent the SAR, and attached a utility bill with my name and address as confirmation of ID. Total Car Parks Ltd have come back to me with the following:

The newbies guide says the following:

"You do NOT have to supply intrusive ID (intrusive = driving licence or Passport) so refuse that if they demand it, but you do have to show that you are the correct data subject. So attach a scan of your V5C if you still own the car, or if not, a utility bill to show your name and address."

How should I respond? Shall I simply state that the requisite information has been supplied, and the 30 days starts immediately?

Thank you

  • What an ignorant letter from TCP.

Some of these PPC's have no intelligence.  Nobody should ever provide a drivers licence or passport .... remember this is a scam industry.

So send two forms of ID.
A REDACTED UTILITY BILL OR Vehicle V5
A REDACTED COUNCIL BILL, BANK STATEMENT or similar.
They have accused you of maybe stealing anothers ID ......

Yes tell them the 30 days is rolling and thereafter you will report them to the ICO
  • Absolutely outrageous - what a bunch of W*****S - they're clearly trying to make it as difficult as possible for you - don't under any circumstances let these scammers get copies of these important documents - you'll then run this risk of identity theft and we all know where that could lead to. V5C is the easiest.

I can't see where the PPC are asking for a copy of your passport or driving licence, where are they asking that?
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

  • Follow up from Total Car Parks after providing a redacted bank statement and informing them that the 30 days has commenced.

    Dear XXXXXXXXX,

Whatever information you receive on a letter is susceptible of having been stolen, that is why we require a photographic ID.
If you are unable or unwilling to provide it, please consult the ICO, you do not need to wait 30 days, as it is the company's policy to request photographic ID and we cannot send you any information without it.
As I have mentioned before, we have consulted the ICO and they understand why we request that. If you want to confirm with them please do, and if they agree in writing that whatever you have sent so far is enough then we will immediately release the information, as we have it ready.

    What are the next steps?

Here is the original response to my request.

Maybe you should have included that in your opening post. Anyhow ..... if they are refusing to provide your data without photographic ID (they don't know what you look like, so how does a photograph confirm your ID?) then send a complaint to the ICO.

I particularly like the bit in the communication in the first post about how anyone who wanted to could 'snatch a letter containing one'. I just love the thought of being targetted by a Random Snatcher. And containing what exactly? :)
  • It's just getting funnier and funnier. To the ICO I guess!
