Company Vehicle Speeding Fine

Hi,

Someone from HR at my employer contacted me to say they've received a court summons (didn't say what for explicitly) with regards to speeding fine I received back in June last year in my company car. I've never had any other correspondence on this, other than a mail from the car leasing firm which my employer uses, to say they are deducting a £15 admin fine due to a speeding fine. 

No one was in the office last summer due to COVID so they've clearly missed the correspondence sent by the leasing firm to my employer. Surely I can't be held liable here

    Were you driving the car at the time of the alleged offence?  You're probably liable....

    When you say you had an e-mail from the leasing firm - can you go back and check exactly what it says.  They as Registered Keeper will have received the first ticket and should have nominated you as the driver so you got your own ticket.   Presumably they nominated you at the business address.
    I need to think of something new here...
  • Go back to HR as a matter of urgency and ask them exactly what they've received and to scan it and send it to you.  You need to know what you've been charged with.  It's probably a speeding charge and a failure to identify charge, but you need to find out for sure before you take any more steps.

    Also contact the lease company who you got the "mail" from and ask them exactly what they did.  You need to know if they named your employer in response to the NIP they received form the police, or whether they named you.  In either case you need to know what address they gave to the police.  If the company was named you need to find out what happened to the paperwork the police would have sent them.  If it was you who was named, you need to try to find out why you haven't received the paperwork the police would have sent you.

    You might also want to post on pepipoo, but don't register with a hotmail address.  (They might also ask the same questions I have)

  • It's probably a "Single Justice Procedure Notice rather than a summons. But whatever it is, what has your employer receiving a summons/SJPN (presumably addressed to them) got to do with you? I have a suspicion what has happened but if you answer Manxman's questions we may get to the bottom of it.
  • If the company has been named but not you personally, then they as a company have committed a crime that you cannot now be charged with.  Who is named on the summons?

    No, it means they are accused of a crime, not that they’ve committed one. That’s what courts are for,

    Until someone pleads guilty or is found guilty in a court of law then no, no one has committed anything.

    The performed the act so therefore committed it.

    Since there is no such thing as a £15 speeding fine, did you ask any questions about this, did you pay the £15?
