Following MIL Collections - “Unreasonable conduct in litigation” - now Gladstones are having a go!

In April 2018 I won a county court case brought by MIL Collections and the judge ordered them to pay me £750 in compensation. The case was well reported here and the detail are still in this forum. 
Imagine my surprise when I received a claim from Gladstones just two days ago (almost 4 years later) for the same alleged parking charge. 
I have written to them pointing out the case has been dealt with in court. Can the parking company, Llawnroc, further assign an alleged parking charge that has already been claimed and lost by another company?

    Email a SAR to the DPO at llawnroc to obtain all your data attaching copies of 2 recent redacted utility bills as proof of I D under the GDPR law

  • Given Gladstones' challenges with inadequate record keeping, you do wonder if your case has been caught up in that mess? You wouldn't be the first to have action brought by them on a settled case. Read here:

    Unreasonable behaviour PPC/Gladstones?  Perhaps another pay day for you @georgd84?

    You need to be absolutely certain that this is for the exact same PCN. Not just the same date, time, and location, but the same PCN number.

    Thank you for all of your interest. 

    What I can tell you so far is that the original parking charge notice was received on 30/05/2017. I have found a copy of the judgement which I will summarise. The main reasons the judge found in my favour were.

    1. Mil uses false names in court documents.

    2. The MIL arguement used the wrong carpark name.

    3. MIL failed to comply with FCA rules regarding disputed debt.

    4. MIL failed to comply with court rules regardiing the service of documents.

    and this is the interesting one I guess - 5. the assignment document 'may not' have been legal as it was clearly photocopied and witnessed by someone whom also appeared to have a made up name.

    Once again I am extremely grateful for the interest and help and my question remains - can a civil case be brought back to a court after it has been determined.

    If that is allowed then anyone could correct matters that a judge didn't like and then keep returning until they won. In criminal cases 'double jeopardy' is not allowed.

  • PS. Im looking for the original court bundle to answer the question about the PCN number. But I only received one PCN at the time.
