Selling flat in London without cladding

Hi, I'm just looking for opinions on this situation with selling my husband's flat in central London. The flats are brick built, 4 storeys high and have no cladding. We tried to sell it in 2020 but the buyers mortgage company refused lending as the flats don't have an EWS1. That sale fell through. We tried again at the back end of last year and got a buyer who also needed a mortgage. They buyer's lender (HSBC) approved the mortgage this time so all good! The buyer then went on to commission a homebuyers report and that surveyor has questioned if it does need a EWS1. Our solicitor said "of course not, here's the updated RICS guidance". However, the buyers solicitors are pushing for a guarantee from the freeholder that all future repairs regarding fire safety will be not passed to the leaseholder. Our freeholders won't agree to this as who knows what future regulations will look like but the buyers solicitor is still pushing. The flats have a FSA report which is fine and a flat sold in the building a few months ago. It just feels we're stuck and we were supposed to be exchanging in the next week or so. Any advice will be very much appreciated.

It might be worth mentioning that the buyers are foreign and may not quite understand how leasehold works in the UK. The estate agent is going to talk to them..0
