CISAS telecom decision against Talk Talk

    First I'm not law expert at all , just wanted to clarify few things, I'm extremely furious about talk talk , Everyone has the right to accept or refuse any offers taking consideration many personal factors...Some of you seem very happy for me to take the 750 Pounds, I M NOT AT ALL 

    At the beginning of the contract Talk talk  accepted responsibility after they noticed the deliberate mistake made by one of their customer service representative to sign me the contract, he lied......they offered me through  their correspondence to cancel the contract without breakage fees ..I did accept the offer to cancel the contract with a BIG happy relief and send them email  to confirm that I don t want anymore to stay in this painful contract , also went through their painful security checks to cancel the contract .. I couldn't bear anything to do with TALK TALK 

    Ironically they decided to give my detail to debt collectors, I was bombarded for two years with threatening letters, court hearings, preparing and asking each time help to write defenses, Set aside applications....... etc.... it was very very exhausting for me 

    Even a  judge during a hearing told talk talk representative : why you are here when talk talk clearly accepted  responsibility to cancel the contract !!!  after submitting my last defense,  I   received a letter from debt collector saying they dropping the case 

    I would explain to the court all the aspects of this case and the impact on me..E mails, letters, doctor reports, hospital appointments will be presented to the court to consider..Its up to the court to consider them or not 
    By the way stress can kill and make bad damage to the body, its not about a bill !!!! Also I would explain to the court that s an ongoing issue with talk talk service since decades and decades ... 

    I'm stress prone person and this case affected me a lot

    You've got the debt collectors off your back and TT have made you a reasonable offer.

    There is nothing saying you have accepted their offer that I can see.

    If you are so stressed by it all you should have taken it and walked away but that ship seems to have sailed especially as you have now posted their offer on a public forum.

    On what basis are you taking them to court and what resolution will actually give you satisfaction and closure ?

    Thanks for replies, true I have problem with written English(  speaking 5 languages, trying my best )  my apologizes  ...  the claim is not vexatious and won t be,  I did not break any confidentiality  ....I don t have any commitment towards TALK TALK ....I did not accept the offer....  I have the right to present my grounds to the court ... this my basic understanding of the law :smile:

    I have the feeling talk talk is watching this forum :smile:

    Talk talk threatened me over the phone to be charged  if I do not accept their offer which made me upset .... I m not accepting the offer and I would be happy to go to the court .... There are many grounds for this claim 

    I will do my best to improve my written English..

    How much compensation are you seeking ?  That's the bottom line.

    You've misunderstood what the letter says ... their letter is their offer to settle the claim, and their terms if you accept. :)

    How much money will satisfy you?  Is £750 almost there?  Halfway there? 10% of what you're looking for?
  • please i need suggestions on what to do. 

    My family have suffered an undue hardship emanating from my broadband service that was disconnected on 26th of April 2022. We stayed without internet for about two weeks.

    Apart from undue stress and disruption of normal life, we have suffered a huge financial loss. My wife lost a new job which was barely two weeks. This is a four months initial contract of £35 per hour. To intimate you, we have planned to relocate to Manchester from Scotland on the 12th of May. My wife had a job which she travelled to Manchester and was given a laptop to work from home before we finally move on the 12th of May. She has to resign from her current role.

    A couple of days after contacting Talktalk for a home move, I received an email from Talktalk saying my broadband will stop working on the 28th of April. Before I could have chance to contact Talktalk to discuss about it our broadband service was terminated on the 26th of April. That was when our ordeal started. All efforts to get our service back met deaf ear as we are still two weeks prior to moving over to Manchester. I and my wife pleaded with all the customer agents we spoke to explaining that we both work from home. However none of the people we spoke to listened to us. They all said it is irreversible.


    I tried BT WIFI and EE Dongle and both could not load my wife work files. I barley was able to work with EE dongle with intermittent drop in network. Note that I lost my wage on the 26th of April. We spent the whole on the phone trying to resolve issue and also going Currys to buy EE Dongle.

     My wife job was terminated on 03/05/2022 because she cannot work and was directed to return the laptop given to her.

    So, from the 26th of April there was no income from my wife.

    The first call i received from Talktalk after putting a complaint was to ask if i still want my service to be restored. At this time we have already relocated and not necessary any more. This simply means that my service could have been restored but they chose not to.

    Talktalk confirmed that they are sorry i was not informed that my broadband service will be terminated earlier before our relocation and agreed for a compensation of barely over £100 which i rejected.

    Please i need ideas on how to further this case with Talktalk

  • @anunobid you cannot piggyback on another member's topic who has had an entirely different issue.

    However, TT do not compensate for loss of earnings or any other consequential losses or expenses on home broadband contracts.

    Your only option is to make a formal complaint about the mistakes they have made, if not satisfied with their reply and any offer of compensation, do as the OP has done, take the complaint to CISAS.

    It may help if you were to understand that it is not the case at all that Talktalk could have reinstated your service but chose not to
    They are 100%  dependant on Openreach who are a law unto themselves
    Talk Talk will give you a service level agreement which states roughly translated says  "we will fix it when we fix it"
